프로스포츠계약의 문제점과 스포츠 에이전시

경제적 강자인 구단과 약자인 선수 사이에 발생하는 문제는 한국 프로스포츠계가 공통적으로 안고 있는 ‘계약’의 문제에 기인한다. 즉, 프로스포츠계약은 그 법률적 성질이 분명하지 않아 민법상의 전형계약으로는 규율할 수 없고, 서구의 프로스포츠와 달리 그 연륜도 길지 않기 때문에 제도의 정착이 부진한 상태이다. 보류선수제도, 자유계약선수제도(FA), 트레이드제도나 신인선수 선발제도(드래프트) 등의 서구 프로스포츠에서 먼저 도입된 제도가 몸에 맞지 않은 옷처럼 필요하긴 하지만 다소 거추장스럽거나 불편한 제도가 되기도 하고, 경우에 따라서는 선수들을 옭죄는 수단이 되기도 한다. 야구규약하에서의 프로야구선수들이 구단과 직접 대면하여 계약을 맺도록 하고, 보류선수제도나 FA제도, 드래프트제도 등을 악용하여 선수들의 스포츠활동을 제한하거나 막는 불합리한 현상을 방지하기 위해서는 최근에 많이 논의되고 있는 에이전트계약(Sports Agency)을 활용하는 것이 바람직하다고 생각한다. 스포츠 에이전트를 활용함으로써 선수는 훈련과 경기에 전념할 수 있고, 전문가가 연봉협상이나 기타의 흥행계약을 담당함으로써 계약을 더 나은 조건으로 유리하게 체결할 수 있기 때문이다. 스포츠 에이전트제도와 더불어 에이전트의 자질과 윤리성 등을 확보하여 선수의 권익을 증진하는 법적·제도적 뒷받침이 이루어지도록 하는 것도 중요한 과제라고 생각한다.
Abstract
Professional sports can be defined as any athletic endeavor in which the player participants are expected to receive compensation for their performance. All athletic activities in which this is a primary goal of the participant fall under this category, regardless of the exact nature of the sport involved. This article will discuss the association articles and regulations, which are regarded as the prime source of law, of professional baseball. It will also deal with the legal effects of association articles and regulations on professional baseball players as well as discuss whether these articles and regulations are subject to the General Condition Clause. Furthermore, it is necessary for us to understand the nature of player's contract. And several problems are there in KBO's regulations such as trade system, draft system, FA system and so on. The author insist that the sports agency system is very useful for resolving problems in this article. Professional agent can lead a contract in favor of players and he/she can make a plan which is needed after retirement for players. And it is important that we rember being in need of quality and ethics of agent.
