북한의 헌법개정과 권력구조 변화 연구: 2009년 개정헌법의 특징을 중심으로

이 논문은 북한이 최근 개정한 헌법의 주요내용 및 특징이 북한의 권력구조 변화와 김정일 국방위원장의 후계구도에 미칠 영향을 분석하는데 목적이 있다. 지난 10여 년간 북한의 권력운영은 헌법적으로 최고주권기관인 ‘최고인민회의’와 ‘최고인민회의 상임위원회의’가 아닌 최고군사지도기관에 불과한 ‘국방위원회’를 중심으로 이루어졌다. 그러나 2009년 4월 헌법개정으로 국방위원장은 북한을 실질적으로 이끌어가는 최고령도자(제100조)로서, 국가의 일체 무력을 지휘통솔(제102조)하며, ‘국가 전반사업의 지도권’, ‘중요조약의 비준 또는 폐기권’, ‘특사권’, ‘비상사태･전시상태･동원령의 선포권(이상 제103조)’ 등의 권한을 가지게 되었다. 이러한 변화는 대통령제 국가에서 대통령에게 주어진 권한과 유사한 것이다. 그러므로 향후 북한의 통치체제는 김정일의 ‘교시’가 ‘당정책화’되고, 그것이 ‘법제화’하는 방식으로 운영될 것으로 보여진다. 특히, 김정일의 매제인 장성택 당 행정 및 수도건설 부장이 국방위원에 임명된 사실을 고려할 때, 향후 김정일의 권력승계와 관련 국방위원회가 주도적인 역할을 할 것으로 예상된다. 종합적으로 김정일은 국방위원회를 최고인민회의보다 우위에 두는 헌법개정을 통해 자신의 후계자에게 국방위원장직을 승계시켜 후계자의 정통성을 확보함은 물론 권력투쟁을 원천봉쇄하여 안정적인 권력이양을 추구할 것이다.
Abstract
The purpose of this paper is to analyze the 2009 constitutional revision and its impact on the political power structure in North Korea. Specifically, this paper examines changes in North Korea's political power structure and its political leader, Kim Jong Il's political succession prospects by analyzing major contents and features of the 2009 Constitutional revision. North Korea has been governed by both 'the National Defence Committee,’ which is the specified supreme military institution in the constitution, and its chairman, Kim Jong Il during the last 10 years, not by 'the Supreme People's Assembly’ or its Standing Committee which are the highest political institutions cited in the constitution. Therefore, there has been incongruence between the constitution and its application in North Korea in the last 10 years. However, the chairman of the National Defense Committee, Kim Jong Il has formally become North Korea's supreme leader who commands military forces and is entitled to prerogatives of administrative control, pardon, and other powers by revising the constitution in 2009. These prerogatives of the chairman of the National Defense Committee are similar to the authorities of the president in the presidential government. As a result, the 2009 constitutional revision increased the level of congruency between the constitution and its application in North Korea. Based on these analyses, we conclude that the National Defense Committee will play a major role in the process of political power succession in North Korea in the future. The next chairman of the National Defense Committee will become the real political leader of North Korea as Kim Jong Il's successor.
