UI 디자인의 개발 프로세스에 따른 다면적 권리 보호 방안

This paper examines the legal protection of UI design that is so difficult to judge the scope of a right and Patent infringement or not. Firstly, I carry out analysis of Patent Law, Design Law, Copyright law, Trademark law, Unfair Competition Prevention and Trade Secret Protection Act concerning UI design area and examine with some cases the rights of UI design that are complementarily protected through each law. Secondly, I draw up sequential guidelines for the object of legal protection related to UI design based on design outputs from each stage in whole UI design process. Thirdly, I examine important worth protecting of outputs from each stage and try to get the omnifaceted protection method for efficient protection of UI design. Finally, I examine the distinguishing problem of UI design on infringement judgement. In summary, I draw up sequential guidelines keeping up with the whole process of UI design and suggest the omnifaceted protection method from important worth protecting, scope & effect of protection of each output, and the exercise of a right & criteria of infringement. I hope that this study lays the foundation for future work on investigation into worth protecting digital Interface design.
