인도네시아 혼인법제에 관한 연구

Although more than 80 percent of Indonesian people believe in Muslims, the Constitution defines Islam or Sharia for national unity and maintains secularism and has a dual judicial system of general and religious history. As exchanges between Korea and Indonesia increase, systematic research on the legal system that can support them will be needed. In our reality of entering a multicultural society, we must have an understanding of the family system of various countries, and the need to study the marriage system in Indonesia, which ranks eighth in the total number of foreigners living here, is even greater. In particular, regarding marriage, we could see that the common law, civil law, marriage law, marriage regulations during the Dutch era, and Islamic law have complex structures that vary depending on the region or religion. The purpose of this paper is to support human exchanges between Korea and Indonesia theoretically through the correct understanding and research of such complex marriage laws. To this end, II. An overview of marriages and divorces under Islamic law; III. In the course of the development of Indonesian marriage laws, we look at the development of mixed laws in the period of common law, the period of colonial rule, and after independence. And IV. In Indonesia's Marriage Law system, it is analyzed in Civil Law, Islamic Law, Marriage Law, and V. In the concluding sentence, we will look at the characteristics of Indonesian marriage legislation and present the direction of research.
