데이터사이언스와 입법실무 : 국회입법조사처 도입전략의 시론적 구상

Recently, discussions on legal use of data science based on legal tech or legal AI have attracted attention. These technical discussions are being developed mainly on judicial decisions. In this respect, this article explores in a realistic way how to use data science in the legislative field. This article analyzes the case of National Assembly Research Service, which provides the most comprehensive analysis service among the legislative support organizations within the National Assembly. Emerging technologies including data science seem to have limits in automating all legislative process. Therefore, it is necessary to look for ways to enhance the democratic and specialized characteristics of legislation from a realistic perspective, rather than be seduced by its technical possibilities. This needs a careful review of the data required for legislative practice and its use. In this regard, this paper analyzes the task characteristics of National Assembly Research Service from the viewpoint of Legislative Studies. Based on this, the strategy to introduce the data science for the legislative practice is presented. In legislative field, the search for a variety of realistic ideas in the use of automation technology is important. More important than that, however, is the limitation of using such technology and the response to that. In particular, this article points out the limitations of technical level, data and administrative convergence, and explanation. Given that legislation has a very public character, it is necessary to consider the limitations of data science and implement strategies for introduction of data science to ensure democratic and professional legislation. This could be an example of democratic re-appropriation of emerging technologies.
