한국 대체적 분쟁해결제도(ADR)의 제도화 및 발전방안에 관한 연구

There are much development of Alternative Dispute Resolution in the world in response to growth and diversity of dispute. ADR implies all methods for resolving dispute without resorting to litigation. In this point, it is said that ADR substitute for traditional court system.There are various types of ADR. The basic forms of ADR can be classified as negotiation, mediation and arbitration. Hybrid forms derived from basic forms contain mini-trial, med-ard, ombudsman, court connected arbitration, court connected mediation, private judging. In Korea, arbitration, mediation, inter-mediation, settlement are mainly used in ADR field. The Korean Commercial Arbitration Board offer arbitration, mediation, inter-mediation. The Court and about forty administrative organizations for example Financial Disputes Mediation Board, Consumers Dispute Settlement Commission, E-commerce Mediation Committee provide mediation programs.In relation to institutionalization of ADR, We need to consider financial assistance, lawyer's perception, cooperation with court, attitude of party concerned dispute to develop the ADR. And device of appropriate ADR process, development of ADR technique can be considered. In conclusion, ADR shall be researched and developed in a viewpoint of responsiveness to modern diverse dispute, right protection of people, international cooperation.
