A Study on Expert Adviser in Civil Litigation

On July 13, 2007, in Korea, Civil Procedure Act was partially revised, and adopted the Expert Comissione.The purpose of the Expert Comissione is to bring sophisticated expertise into expert litigation, and to manage cases efficiently. The Expert Comissioner is a person who gives an opinion based on expert knowledge in a malpractice suit and a litigation related to intellectual property or construction etc.The Expert Comissioner is an assistant of judge and is different with an expert witness.This system is very similar to that of Japan made by 2003 Partial Revision of the Code of Civil Procedure of Japan although there are some delicate points of difference between the two systems.The important things are that a judge must listen to the opinion of parties to a lawsuit as well as the Expert Comissioner and that Ministry of Court Administration must appoint the Expert Comissioner who takes a neutral attitude.
