중국 物權法의 건설용지사용권

The Rights of the Land for Construction in The Law of The Real Rights of China

초록

At last China established The Law of The Real Rights in 2007. 3. 26 and the law has been in force in 2007. 10. 1. According to the law that has the Principle of Legality of Real Rights as the main principle of the law, the rights of the land for construction which is a kind of superficies is a usufruct that not only an artificial person but also a natural person can be the subject of the rights. Especially the law says that an acquisition or a disposal of the rights is based on the principle of a juristic act done for consideration. Also The Law of The Reality of China stipulates implicit renewal of the rights of the land for construction, it means that the implicit renewal makes the owner of the rights has the legal stabilization position. Above the aticles of the Law of The Real Rights of China is meaningful to Korean investors who invest in China. Because if they want to use the loan advance for their acquisition of the ownership or something like that in the legal stabilization position, those articles are helpful to that matter.
