문화도시의 요건과 법적 과제

Modern city residents started to take interest in the quality of life since their living conditions were improved. And they want more opportunities for culture and art. Our Constitutional law has not any clear statement about the principal of cultural nation. But there is no doubt as our Constitutional law implies the principal of cultural nation in many articles. In our country since the implementation of local autonomy from 1995, local governments and residents perceived that revitalization of regional economy depends on advancement of culture. Thus they are concentrating to development of local culture and art as much as development of local economy. In this article, the author researches the bases of cultural city, and examine some legal issues of cultural city. The author thinks there are needs for setting up legal system for fostering cultural city. And it is necessary to have comprehensive improvement of existing laws such as ‘Protection of Cultural Property Act’, ‘Planning and Use of Land Act’, ‘Special Act for Preservation of Old Cities’, and ‘Promotion of Culture Act’ etc.
