소프트웨어 스트리밍 서비스의 법적 문제점 연구

Some copyright issues have been raised in providing software streaming service without the permission of copyright owners. First, the service provider may infringe the right of making available of works to the public, and the reproduction right. Second, a user would make a temporary copy in the RAM of his or her computer. A temporary copy will be included in the definition of the reproduction under the KORUS FTA. The current issue on software streaming is whether it would violate antitrust law or constitute copyright misuse for copyright owners not to authorize software streaming license. This paper deals with the these copyright, antitrust, misuse issues on software streaming, suggesting it would not violate antitrust law or constitute copyright misuse to reject software streaming license.
