대학교수의 아이디어 유출과 창의 자본에 관한 법적 검토

This study focused comparison between employees' invention and research idea by university professors. One of the issues is that research result produced by university professors is whether it is free invention or employees' invention. Lots of scholars in korea think that boundaries of university professors's free invention is very narrow. These days patent licensing strategy is dramatically changing. Thus "Invention Capital" buys not only patent but also immature idea. After they process these idea they make strong patent portfolio. This paper aims to suggest a standard to deal with a free idea and employees' invention. Usually university professor's research idea should be taken employees' invention. However professors free idea should be protected as a free invention.
