영국 해상보험법 상 알릴의무 조항에 관한 연구

초록
해상보험계약의 체결은 낙성계약의 원리에 따라 피보험자가 청약하고 보험자가 승낙하므로 이루어지는 원리로 구성된다. 즉 보험자는 보험목적물의 속성이나 위험의 정도를 잘 알지 못하고 또한 이를 실질적으로 확인 할 수 있는 방법은 불가능하므로 보험자는 피보험자로 하여금 보험계약을 체결하기 전에 피보험자가 알고 있는 중요한 사실을 알리도록 하고 이를 기초로 하여 보험요율을 산정하고, 보험계약체결 여부를 결정된다. 이러한 과정에서 알릴의무의 중요성을 인식하게 된다. MIA 제18조∼제20조에서 해상보험계약은 알릴의무 계약임을 명시하고 있다. 즉 보험계약의 체결과 동시에 알릴의무는 소멸된다고 볼 때 부실표시에 대한 취소권을 행사할 수 있는 기간은 MIA 상에서는 특별히 명시하고 있지 않아 보험계약기간 동안 지속된다는 광의적으로 해석하고 있다. 본 연구는 알릴의무에 대한 개념을 중심으로 법적인 성질에 따른 알릴의무의 성립요건들의 일반적인 고찰을 하는 과정에서 의무위반에 따른 보험자의 취소권과 입증책임을 중심으로 한 보험자 및 피보험자의 상호간에 이익이 되는 방향을 모색하였다.
Abstract
The Marine Insurance Act specifies that the insured subscribes for insurance and the insurer approves it according to the principle of contract. That is, as the insurer does not know properties or risks of the insured subjects and it is impossible to confirm them, the insurer asks the insured to disclose important facts they know before the contract and based on the report and they obtain rates of insurance and confirm the insurance. In this process, it is recognized that the obligation of disclosure is important. Articles 18 and 20 of MIA specify that the marine insurance act is based on the obligation of disclosure. That is, when it is considered that the obligation of disclosure disappears at the same time the insurance contract is concluded, as the period when the right of cancellation is available is not specified in MIA, it is broadly interpreted it lasts for the insurance period. This study speculated factors of disclosure obligation based on its legal properties to discover the mutually profitable directions between the insurers and the insured centering on the right of cancellation and the burden of proof when obligations are violated.
