In civil litigation in Korea, representation of legal attorney is not required. Should a party is willing to ask legal attorney in his or her law suit, legal attorney is asked in law suit, attorney fee is burdensome. Owing to its cost, the issue of attorney fee is considerably substantial factor to decide the representation. In terms of information provision, enactment of regulation relating attorney fee attracts more attention. In this regard, practice of setting attorney fee in Germany will be discussed here with the perspective of comparative law and an appropriate, transparent and legalized setting of attorney fee will also be considered.
