우리나라의 특허심사 및 심판에 관한 실증연구: ‘결정계’특허심판을 중심으로
An Empirical Study on the Patent Examination and Re-examination Request: the Case of ‘Ex-parte’ Re-examinations

본 연구는 2007년도 우리나라의 특허출원 및 심판 데이터와 기업의 재무자료를 결합하여,특허심사와 심판에 나타나는 특징들을 실증적으로 분석한다. 특히 발명인의 특허출원 이후특허심사청구에 이르는 시간 또는 기간이 특허의 등록 여부와 거절결정에 대한 불복심판청구 여부에 어떠한 영향을 미치는지를 실증적으로 살펴본다. 통계분석은 전반적으로 특허의가치가 높을수록 특허거절결정의 확률이 낮고, 거절결정에 대한 불복심판청구의 확률이 높은 것으로 나타나 기존의 연구결과와 일관된 모습을 보였다. 그러나 일반적인 인식과는 달리 다른 요건이 동일하다면 중소기업의 출원특허가 등록결정될 확률이 더 높은 것으로 나타났으며, 거절결정된 경우에도 불복심판을 청구할 확률이 더 높은 것으로 나타났다. 회귀분석 결과는 또한 특허출원 이후 특허심사청구에 이르는 기간이 길수록 출원된 특허의 등록확률이 높아지고 거절결정 되어도 결정에 불복심판을 청구하는 확률이 낮아지는 것으로나타나, 특허심사의 연기가 특허의 가치제고와 불확실성 해소를 위한 자기심사의 역할을 수행하고 있음을 보였다.
Abstract
This paper investigates the pattern of patent examination and the associated re-examination process. The study, in particular, examines how deferred examination of patent applicant affects on the probability of grant and the probability of re-examination request when the patent application is rejected. The regression results suggest that the deferred examination shows statistically significant and positive relationship with the probability of grant and the probability of re-examination request. This implies that deferred examination plays an important role in remedying patentability and resolving the uncertainty of patent value. The regression result also shows that the patent application of small-medium company has higher probability of grant and re-examination request.
