부담금제도의 특성 연구 -행정부처 98개 부담금 내용분석-

초록
본 연구는 우리나라 부담금 규모나 징수액은 막대하여 그 중요성이 큼에도, 이에 대한 연구경향은 법리적 측면에 초점을 두었고 행정학적 접근연구는 미미하였다. 본 연구는 이점에 주목하고 행정부처에 설치된 98개 부담금제도의 내용분석을 통해 우리나라 부담금제도의 특성을 분석하였다. 연구결과에 따르면 첫째, 부담금 부과목적이 정책실현보다 재정조달 목적인 부담금이 상대적으로 많았다. 둘째, 공공사업 또는 공공시설로 인해 특별한 이익을 받는 자에게 징수하는 수익자부담금 유형이 많다. 셋째, 우리나라 부담금 설립목적이 부담금을 하나의 정책수단으로 활용하여 정책목적을 달성하기 보다는 순수한 재정조달에 초점을 둔 것이 상대적으로 많아 부담금제도는 정책수단으로서 성격은 부분적이다. 넷째, 정책목적 실현을 위한 비용은 원인행위자에게, 재정조달인 경우는 특정사업에 따른 편익을 누리는 수익자에게 비용을 부과하고 있다. 다섯째, 부담금재원 소유는 중앙정부기금이 가장 크고 기초단체 귀속부담금의 증가율이 높았다. 정책적 시사점으로 행정부처의 부담금 선호경향, 중앙정부중심의 부담금제도 운영경향, 부담금 배분방식개선 등을 제안하였다.
Abstract
This study examines the characteristics of charges system related to central government inKorea. The present articles are intended to serve as a legal approach to charges study of centralgovernment. Thus, this paper is conducted in a content analysis approach through 98 chargesrelated to public agencies in central government. To do that, the results are as follows. First, thegoal of a charges imposition has many more a fund's gain than a policy executive toproblem-solving though charges. Second, the type of a charges is rich in imposing a beneficiaryon the government's project and public facilities building. Third, the personality of charges is alimited as a policy instruction to problem-solving, because they is frequent in more fund's gainthan the others. The government is used it so many as instrument to prepare financial resourcefor a specified benefit project because of reduce tax resistance. Fourth, we suggest a possession ofcentral government in fund amount, reform of fund division, and preference of centralgovernment to make charges in the implication of this paper. Despite, this paper is a basic studyin the level of exploratory research. We hope this article is able to provide an incentive forunderstanding a charges and fees of public agencies.
