중국의 반도체집적회로 배치설계 보호에 관한 연구

초록
산업의 쌀이라고 불리는 반도체는 정보산업사회에서 고부가가치의 첨단전략산업의 하나이다. 배치설계란 집적회로를 제조하기 위하여 회로소자 및 그것을 연결하는 도선을 평면적 또는 입체적으로 배치한 설계를 말한다. 반도체 집적회로배치설계는 최소의 공간에 회로소자를 집적시켜 전자회로의 기능을 수행하도록 하는 집적회로의 공간적 배치를 나타낸 설계로서 이를 특허로서 보호하고자 하는 경우, 신규성, 진보성 등의 판단이 곤란하여 특허부여가 어려우며, 또한 기술개발이 발전하고, 제품의 life cycle이 짧기 때문에 심사기간이 긴 특허로는 배치설계의 권리보호가 곤란하다. 중국의 집적회로 배치설계는 정보산업의 핵심적 기술로서 정보산업의 기초 역할을 하고 있다. 2011년 1월 28일 국무원이 공포한 프로그램산업과 집적회로 산업의 발전을 진일보 격려하기 위한 약간의 정책에 관한 통지(进一步鼓励软件产业和集成电路产业发展若干政策的通知)(国发 [2011] 4号)는 집적회로 산업이 국가의 전략산업이며 정보화를 위한 기초적 역할을 한다고 표명하였다. 중국의 반도체 집적회로 배치설계에 대한 보호는 경제발전과 더불어 세계무역기구(WTO)의 가입에 따른 지적재산권 보호를 위한 정책의 일환으로, 2001년 3월 28일, 제36차상무회의에서 국무원이 집적회로배치설계보호조례(集成电路布图设计保护条例)를 통과시켜, 2001년 10월 1일부터 시행하고 있으며, 이와 동시에 국가지식산권국도 집적회로배치설계조례실시세칙(集成电路布图设计保护条例实施细则)을 공포하여 2001년 10월 1일부터 시행하고 있다. 본 연구에서는 중국의 반도체 집적회로배치설계의 개념 및 배치설계권자의 전용권, 침해구제, 문제점 및 개선방안에 대하여 살펴보고자 한다.
Abstract
Semiconductors called rice of industry is one of high value-added high-tech strategic industries in the information industrial society. A layout design means the two-dimensionally or three-dimensionally placed design of conductors and circuit elements to connect them. Semiconductor integrated circuit layout design means the design of showing the spatial arrangement of integrated circuits to enable functions of the electronic circuit to be peformed by integrating circuit elements in a minimum space. In the event of protection of the design as a patent, it is difficult to grant it a patent since it is hard to make the judgement of novelty, progressiveness, etc. In addition, the development of technologies proceeds and the life cycle of products is short, so it is difficult to protect the rights of layout design with a patent requiring a long period examination. Layout designs of integrated circuits, China has the basic role of the information technology industry as the core of the information industry. January 28, 2011 the State Council promulgated a Encouraging the Development of the Software and Integrated Circuit Industries Several Policies integrated circuit industry, information industry and the national strategy for the fundamental role that was expressed. The protection for semiconductor integrated circuit layout design in China has been enforced as thew State Council passed the Integrated Circuit Layout-design Protection Regulations in the 36th executive meeting Match 28, 2001 as part of the policy for the protection of intellectual property rights after sign-up with the World Trade Organization (WTO) along with economic development. At the same time, the State Route Integrated Circuit Design Layout Intellectual Property Act Implementing Regulations has been announced, effective from October 1, 2001. This study tried to examine a concept of semiconductor integrated circuit arrangement design, exclusive rights of layout design licensee, infringement remedies, problems, and improvements.
