동의의 본질과 구조 ―자기결정의 자유―

초록
이 글의 목적은 동의의 개념을 본질과 구조의 측면에서 해명함으로서 동의 개념의 해석을 위한 기초를 마련함에 있다. 이를 위하여 두 가지 역사적 맥락 속에서 발전해 동의의 이론을 검토해 보았다. 그 하나는 피지배자의 동의에 의한 지배의 정당화이론이고, 다른 하나는 사람들 사이의 관계 형성의 기초로서의 동의 이론이다. 여기에서 동의에 있어서 두 가지 해명의 필요성에 직면하게 된다. 하나는 동의의 본질로서 자기결정의 위상과 그 외의 가치들의 관계를 정립하는 것이고, 다른 하나는 동의의 기능과 요소들, 그리고 그 관계를 분석하는 것이다. 이러한 양자 간의 관계를 적절히 조합할 수 있을 때, 동의 법리 해명을 위한 기초가 완성될 수 있을 것이다. 그래서 동의 이론들을 통해 동의가 가지는 의미와 특징, 요소, 그리고 다른 개념과의 관계를 분석하였고, 자기결정의 자유와 다른 가치들의 관계를 검토하였다. 그 결과 본고는 동의가 자기결정의 자유이며 인간 존엄의 한계 속에서 승인되는 것이어야 한다는 점을 그 내용으로 하는 동의의 모델을 제안한다. 이때 동의의 성립은 동의의 행위자와 동의의 상대방 사이의 상호작용이라는 내적 관계의 구조를 통해 확인되며, 동의의 승인은 인간의 존엄성의 한계 속에서 이루어져야 한다.
Abstract
The Purpose of this paper is to build a base for the interpretations of concept “consent” by explaining the concept in the context of its nature and structure. In an effort to obtain clues for the interpretations of content, this paper reviewed consent that had developed in the two historical contexts of consent, consent by the governed for the authority of government and consent between persons. Here rises a need for two explanations: one is to establish relations between the status of self-determination as the nature of consent and other values, and the other is to analyze the structural characteristics of consent. When such bilateral relations are properly combined, a foundation will be completed for the explanation of the legal principle of consent. The paper thus reviewed first the issue of how to combine the relations among many different values proposed in consent, and reviewed the relations between rights and consent through Hohfeld’s analysis of rights and the functions of consent. Finally the paper found out the priority of self-determination among other values, and human dignity as the limit of consent and according to these results established a model for the interpretation of consent. This model was comprised as follows: the establishment of consent is confirmed in the structure of internal relations between the consenting agent and the recipient and approval of consent is confirmed in the structure of external relations among the values which hierarchy establishes through human dignity.
