노인범죄자에 대한 보호처분제도 도입방안에 관한 연구

As Korean society has turned into an aging society, there is an increase in elderly crimes, though the nation has taken all sorts of related measures. As for the common type of elderly crimes, property crimes that are crimes for a living take place a lot. The reason is that senior citizens has no income and consequently cannot earn a living, being poverty-stricken. Besides, it's difficult for them to find new employment. As a consequence, the recidivism rate of elderly criminals is high, and elderly crimes are expected to be on the rise under the circumstances. It's now required to carefully consider how to reduce elderly crimes and prevent second conviction. To prevent elderly crimes and second conviction, the introduction of protective disposition is required. To make it happen, the causes and state of elderly crimes and the necessity of protective disposition were presented in this study. And then how to determine on protective disposition for elderly criminals, what additional disposition would be necessary in addition to probation and how long the protective disposition should be long were suggested in terms of the legislation of protective disposition for elderly offenders. Concerning post-management after the end of protective disposition, it's suggested that crime prevention services tailored to the characteristics of elderly people should be provided, and that elderly criminals should be assisted in finding a new job. If the nation or society makes an intensive effort as to elderly crimes, it will contribute to reducing these crimes, and further, it will facilitate the resocialization of senior criminals, thereby being of use for their stable social rehabilitation.
