공공성의 정치이념적 스펙트럼과 헌법상 공공복리

This article focuses on the theme of publicness, the core value of the Democratic Republic, and notes that it is a multidimensional concept that reflects ideological differences between individuals or groups. At the same time, the ideological coordinates categorized as ‘extreme left-middle left-middle right-extreme right’ to examine the corresponding content of publicness. In the text, I will set up the ‘partisan publicness-positive publicness-residual publicness-anti publicness of market fundamentalism’ as ideological spectrum of publicness and refer to the contents of publicness corresponding to each ideological coordinate. On the other hand, reviewing the constitutional public welfare and analyzing related precedents of Constitutional Court of Korea using the political ideological spectrum of publicness is also an important subject of this study. Through this, I will examine public welfare as a constitutional design of the implementation of publicness and trace the interpretation trend of a constitutional court precedents to embody this. At the conclusion, I will evaluate the fact that constitutional public welfare communicates with the content of ‘positive publicness’ and that public welfare in the constitutional court precedents flows from the left and right of the publicness spectrum.
