소년 범죄 예방을 위한 불교적 방안 연구- 형법범죄 중심으로 -

초록
오늘날 우리 사회 발전으로 인해 범죄 발생의 양적․질적 양상이 다변화되고 있으며, 그로 인해 범죄 예방과 근절이 더욱 어려워지고 있다. 특히, 소년 형법범죄의 저 연령화·사기 등의 지능화 범죄 증가, 재범의 증가의 추세는 오늘날 중요한 사회 문제로 발전하고 있다. 소년 범죄의 원인은 미성숙성으로 잘못된 판단과 부모의 역할 부재, 사회구조 및 사회기능문제 등의 다양한 요인이 있으며, 이에 소년범죄의 예방과 나아갈 방향에 대해 살펴보았다. 가해자의 참회와 용서를 통한 진정한 화해 제도 개선, 부모로서의 역할에 대한 인식개선, 나아가 미성숙한 존재인 소년들에 대한 “너와 내가 하나이므로 네가 아프면 내가 아픈 것이며, 너의 아픔이 바로 나의 아픔이다.”라는 사회전반의 관심과 이해가 필요하다. 모든 존재가 상호의존적인 ‘관계’ 속에서 공동운명체로서 서로 깊이 연관되어 있음을 우리 모두가 인식하여야 한다. 또한, 상구보리 하화중생(上求菩提 下化衆生)의 붓다의 가르침에 의거하여 소년 자신이 직면한 범죄의 원인을 자각하고, 스스로 문제를 해결할 수 있도록 가정과 학교 그리고 사회가 그 역할을 함으로써 우리 모두를 보호하고 나아가 사회 안정과 발전에 기여할 수 있을 것이다.
Abstract
Due to the development of our society today, the quantitative and qualitative aspects of crime are diversifying, making it more difficult to prevent and eradicate crime. In particular, the trend of an increase in intelligence crimes such as the underage of juvenile criminal law crimes, fraudulent crimes, and an increase in recidivism, is developing into an important social problem today. The cause of juvenile crime is immaturity, and there are various factors such as wrong judgment, lack of parental roles, and problems with social structure and social functioning. Therefore, the prevention and direction of juvenile crime were investigated. Improving the system of genuine reconciliation through penance and forgiveness of the offender, raising awareness of the role of parents, and furthermore, about immature boys, saying, “Because you and I are one, I suffer when you are sick and I will bear your pain.” It requires interest and understanding of society as a whole. We must recognize that all beings are deeply interrelated with each other as a common destiny in an interdependent ‘relationship’. In addition, based on the teachings of the Buddha of 上求菩提 下化衆生, we all need to be aware of the causes of the crimes the boys face and help them solve their problems on their own. protection and further contribute to social stability and development.
