세월호참사가 발생한 2014년 이후 지난 10년 동안 재난 관련 법․제도 분야에 어떠한 변화가 있었는지 확인하고 그 한계를 분석하는 것은 앞으로의 안전활동 강화와 개선방안 마련에 기여한다는 점에서 의미가 있다. 하지만 관련 법률은 그 양이 방대하고 분류 기준도 불명확하다는 어려움이 있다. 이에 본 연구에서는 세월호참사와 직접적으로 관련된 법률로 그 범위를 한정하여 ① 재난 및 안전관리 분야의 기본법으로, 국가의 재난대응 및 안전관리를 위해 필요한 사항을 규정하고 있는「재난 및 안전관리 기본법」, ② 해사안전 및 수색구조를 규정한「해사안전기본법」 및「수상에서의 수색․구조 등에 관한 법률」, 그리고 ③ 세월호참사의 원인조사와 피해지원을 위한 「4․16세월호참사 진상규명 및 안전사회 건설 등을 위한 특별법」과「4․16세월호참사 피해구제 및 지원 등을 위한 특별법」에 변화를 분석하고 평가하였다. 분석 결과 지난 10년 동안 안전 강화를 위해 발전적 방향으로 변화하였음을 확인할 수 있었으나, 세부적으로는 개선되어야 사항이 여전히 존재함을 알 수 있었다. ‘이윤보다 생명’이라는 당연한 구호가 현실에서 구현되기 위해서는 안전에 대한 논의가 국가, 기업, 전문가만이 아닌 일반 시민 중심으로 더욱 적극적으로 이루어져야 하며 관련 법률의 지속적인 개선도 요구된다.
Abstract
Analyzing the changes in disaster-related laws and systems over the past decade since the Sewol ferry disaster in 2014 and identifying their limitations is meaningful in that it contributes to strengthening safety activities and planning for future improvements. However, there is a difficulty that the amount of related laws is vast and the classification criteria is unclear. Therefore, this study limits its scope to the laws directly related to the Sewol ferry disaster and analyzes the following: ① The Framework Act on Disaster and Safety Management, which stipulates the necessary matters for disaster response and safety management in the country. ② Framework Act on Maritime Safety Act and the Act on Search and Rescue at Sea, which stipulate maritime safety and search & rescue(SAR); and ③ Special Act on Investigating the Truth of the April 16 Sewol Ferry Disaster and Building a Safe Society and Special Act on Remedy for Damage Caused by the April 16 Sewol Ferry Disaster and Assistance Therefor. The analysis showed that the relevant laws have evolved in a progressive direction over the past decade to strengthen safety, but there still needs to be some improvements. In order for the common slogan of “life over profit” to be realized in reality, the discussion on safety should be more actively centered on citizens, not just the state, companies, and experts, and the relevant laws should be continuously improved.
