2002년 7월 1일을 기해 우리나라에도 도입된 PL(Product Liability, 제조물책임)법은 바야흐로 소비자가 중심이 되는 선진 시장원리의 도입으로 이해할 수 있으며, 오늘날 소비자 안전을 우선시하지 않는 기업은 시장에서 존재하지 못할 수도 있는 소비자 헤게모니 시대로의 진입을 시사하고 있다. 그러나 PL법의 도입은 제품의 제조와 유통, 판매 등에 관여하는 많은 기업에게 큰 위협이 되고 있으며, 따라서 PL법의 도입에 따르는 전략적인 대응책을 시급히 마련하고 PL 예방을 위한 제품 개발체계를 정립하는 것은 현재 기업 생존에 직결되는 중요한 사안으로 부각되고 있다. PL에 대한 기업의 대응전략은 제품 개발단계에서의 결함 최소화를 통한 사전예방이 목적인 PLP(Product Liability Prevention, 제조물책임예방)와 사고 발생시 법적분쟁 및 클레임 발생에 대한 기업의 효율적 대처가 목적인 PLD(Product Liability Defence, 제조물책임방어)로 나뉘어 진다. 본 연구는 PL법의 이해를 통해 기업이 전략적으로 PL에 대처할 수 있는 여러 가지 방안들을 조사해 보고, 특히 PLP 전략의 일환으로 제품의 PL 결함을 사전에 예방하기 위한 디자인 중심의 접근방법을 고찰하였다. 본 연구에서 고찰된 디자인 접근방법은, 크게 문제해결 도구와 프로세스를 중시하는 방법론(methodology)적 접근과, 거시환경 속에서의 개체간 상호작용과 관련성을 중시하는 시스템(system)적 접근으로 나타났으며, PL 문제의 원천적 예방을 위해서는 안전(safety)에 대한 디자인 문제를 프레임워크(framework)적 관점에서 풀어야 함을 제안하였다.
Abstract
PL(Product Liability) which took effect from July 2002 in Korea, represents that the current market principles are consumer-oriented mainly, and without deep consideration of consumer's safety, companies could never survive in the market competition today. PL gives big threats to the companies being involved in the any part of the process of manufacturing, distribution, sales of products, indeed. It is getting more important and urgent that companies prepare strategic plans for PL and build the product development system based on PL.The strategic plans for PL are divided two categories; PLP(Product Liability Prevention) aims to eliminate or reduce product defects in the stage of product development, and PLD(Product Liability Defence) aims to manage legal issues and claims from consumers after accident occurs which is related with product defects. This paper aims to illustrate PL prevention system through research of PL cases and corporate strategies for it, and identify design approach to achieve product safety. According to this study, there are two design approaches: Methodology- based Approach and System-based Approach. The study found that it is very important to identify design issues for product safety through the framework of integrated product design methodology and system, and the result of the study suggested a design framework model for product safety to achieve PL prevention in the stage of product development.
