초록
재산권은 원숙한 사회가 보호하고자 하는 중요한 사회 질서의 초석이다. 이러한 재산권은 물리적 재산 뿐만 아니라 지적 재산에 있어서도 마찬가지로 보호되어야 할 것이다. 이러한 지적 재산권의 인정과 보호는 노동의 가치, 인격적 정당화, 그리고 공리주의의 관점에서 정당화될 수 있다. 일반적으로 사이버공간에서 공개된 웹 자료의 인용과 관련한 문제는 저작권 관련 자료의 정당한 이용 규정의 위반의 형태로 나타나는데, 이것은 곧 합리적인 행위자 스스로가 다양한 이유에 의하여 도덕적 명령에 복종하기를 거부하는 형태로 나타나기 때문이다. 또다른 형태의 인터넷상에서 공개된 웹 자료의 인용과 관련된 지적 재산권의 침해는 주로 도덕적 타성과 도덕적 태만이 원인이 되어 무도덕성의 형태로, 즉 잘못을 알지 못하는 것뿐만 아니라 도덕적 관심도 없는 형태로 나타나기도 한다. 이러한 문제를 해결하기 위하여 정보공유 라이선스 방법을 통한 저작권 관련 이해의 확장이 이루어져야 하며, 웹 자료의 인용법 표기 규정에 의거하여 정보 출처의 올바른 표기가 이루어져야 할 것이고, 지적재산권 존중을 추구하는 정보윤리교육이 이루어져야 할 것이다.
Abstract
The property right is one of the most important foundation stone of the social order of which the mature society tends to ensure. The intangible property right should be guaranteed as well as that of the material property. The confirmation of intellectual property could be justified as follows: The labor value view, justifying human character view, and the Utilitarian view. Most problems related to quoting web material in the cyber space are related to the infringement of the fair use of copyrighted material on the web. It is caused by the rational agent who denies the moral duty. And another reason which explains that circumstances well is the agent who are amoral and extreme indifference to the morality in the cyber space. The effort which helps to overcome this could be suggested as follows: Pay regard to the intellectual property mind expanding through information sharing licence, precise indication of the web information source with the standard method, and information ethics education that intends to respecting the intangible property of others.
