교육내용에 관한 법적 문제와 과제

본 연구는 법률적 의미의 교육 내용이라는 것이 교육 과정과 교과서라는 형태로 사용된다는 것을 밝히고, 이들 대상을 교육 내용에 접근할 수 있는 권리의 이해 방식에 의해 법적 문제와 과제를 제시하고자 하였다. 연구 과제의 수행을 위해 첫째, 교육 내용의 의미와 이것이 법률상 사용될 경우, 어떠한 형식을 띠는 것인지 논구하였다. 그리고 교육 내용에 접근할 수 있는 권리는 교육 관련 조항 전체를 종합적으로 해석하는 입장과 달리 교육의 본질적 가치에 입각해 해석할 과제가 있음을 제시하였다. 둘재, 교육 과정에 관해서는 교육의 통제성과 자율성의 조화가 핵심 관건이었으며, 이를 위해 교육 과정의 기준과 단위 학교 교육 과정 편성의 문제와 과제를 논의하였다. 셋째, 교과서에 관해서는 국정 교과서와 검정 교과서를 저작, 채택, 사용이라는 측면에서 문제와 과제를 제시하였다. 여기서도 핵심의 교육의 통제성과 자율성의 조화였다. 그리고 이들 논의에서 쟁점은 논쟁으로, 논쟁은 새로운 논쟁으로 이어지는 것이 교육법학의 학문적 성숙을 위해 필요함을 결론으로 맺었다.
Abstract
This study is to suggest the legal issues and some question to solve on the content of education. The results of the study are following. First, It discuss the legal meaning on the content of education. The meaning of the content of education in the education field of study is the contents taught to teachers. On the other hand, educational law field of study makes mention of the curriculum and textbook. Second, It debate the rights for the learning. As a result of the elaborate examination about the 'ability' and 'equal'(Constitution article 31), the constitutional articles and clauses related education shall interpretate on the ground of the fundamental nature of education. Third, It deals with the legal issues on the curriculum. The main issue is in harmony with the regimentation and self-regulation of education. This matter is the legal problems on the power for the standards of the curriculum and the rights for the organization of the curriculum. Fourth, It treats of the textbooks. As the textbook is based the curriculum, the main issue is alike the curriculum issues. Though It discuss the government-designated textbooks and the authorized textbooks, the title is consist of the authorship, selection, and use of the textbook. I generalize legal issues on the content of education. Hence, it is necessary to deeply study each subject in the legal aspect of the content of education.
