영법상 해상보험에 있어서 손해보상의 의미에 관한 사례분석

초록
손해보험계약의 보험자는 보험사고로 인하여 생긴 피보험자의 재산상의 손해를 보상할 책임이 있다. 손해보험이 손해보상의 보험인 것은 명백하다. 그러나 손해보상의 보험 및 손해가 무엇을 의미하는지 그 해답은 단순하지 않다. 이러한 손해보험계약의 본질에 대한 기본적 문제가 실제 문제로서 부상되는 이유는 손해보험의 각종 제도가 직접적으로 적용되지 않는 경우가 있기 때문이다.한편 손해보험에 있어서 손해보상의 의미에 대한 기본적 문제를 취급한 사건으로서 Wind Star호 사건을 들 수 있다. 본 사건의 판결에서는 손해보험의 각종 제도가 충분히 정리되었다고 볼 수 없다. 또한 이것은 결코 판결 자체의 문제가 아니라 손해보험의 근간에 있는 보험계약법상의 여러 문제가 해명되어야 할 연구과제라는 것을 제시하고 있다.본 판결의 의의를 고찰할 경우 본 사건은 법률상의 배상책임이 존재하지 않는다는 특수사정이 있지만 판결이 논리적이 아니며 설득력도 없다. 따라서 거기에 전개되는 기초적 문제의 논의야 말로 주목해야 할 가치가 있는 판결이라고 생각된다.본 연구에서는 손해보상의 원칙이 영법에서 어떻게 이해되고 적용되는지를 분석한 후 본 사건의 판결을 검토하고, 이어서 영국 판례를 중심으로 거기에 포함된 문제가 갖는 이론적 중요성을 제시하는 것에 그 목적이 있다.
Abstract
A contract of non-life insurance is a contract whereby the insurer undertakes to indemnify property loss of the insured caused by insured event. It is evident that a contract of non-life insurance is a contract of indemnity. However, in the insurance and loss of indemnity, the answer is not simple what to them mean. Some fundamental problems on essence of non-lifeinsurance contract is rising as practical problems. The reason is because some systems of non-life insurance is not directly applied in certain circumstances.A case dealt with fundamental problems on the meaning of indemnity in marine insurance is the Wind Star case. In the judgement of this case, I think that some systems of non-life insurance is not perfectly regulated. In addition, this is not problem of judgement in itself, but it is submitted that some problems of insurance contract law in non-life insurance is study to be solved.In consideration of this judgement meaning, this case is special circumstance that legal indemnities is not exist, however, this case judgement is not logical and persuasive.The purpose of this paper is to explore how to understand the principle of indemnity in English Law, to search this case, and to present theoretical importance on problems involved in the English cases.
