법교육의 본질관에 입각한 '법과 사회'교육과정 및 교과서 내용 분석 연구

시민교육으로서의 사회과 법교육은 법현상을 이해하고 일상의 법적 문제나 쟁점을 합법적으로 판단하고 행동할 수 있는 능력을 갖추며 이를 바탕으로 궁극적으로는 ‘준법 의식을 갖춘 책임 있는 민주시민’을 양성하는 것을 목표로 한다. 이런 궁극적인 목표를 달성하기 위하여, 법교육은 학습자에게 제공하는 학습 경험의 성격(학습내용)이나 교수-학습 과정을 다양한 방식으로 제공할 수 있다. 학교 사회과에서 법교육 영역은 이런 접근 방식들 가운데 어떤 개념으로 접근하는가에 따라 내용, 학습 과정, 학생, 교사 등 교수-학습 과정을 구성하는 요소들에 관한 기본적인 생각이 다를 수 있다. 그러나 법교육을 어떤 관점에서 접근하더라도 중요한 것은 특정 개념관이 상정하고 있는 요소들 사이의 일관성을 유지하는 것일 것이다. 현재 ’법과 사회‘ 교육과정은 내용 체계에 있어서 범위와 계열의 일관성이 약하며, 학습 내용 역시 다양한 성격관을 동시에 취하고 있다. 이런 개념관의 혼란은 학교 현장의 사회과 법교육 수업의 혼란으로 이어질 것이며, 입시위주의 교육이 성행하는 우리 학교 현장의 풍토 속에서 학생들의 학습 부담만 가중시키는 결과를 낳을 우려가 클 것이다.
Abstract
The purpose of this study is to analyse ‘Law and Society' textbook and the 7th National Curriculum of social studies in terms of nature of law-related education. For this purpose, this study analyzes the goal, the learning content and the approach to law-related education of 'Law and Society' curriculum and textbook. Results of this study are as follows : First, 'Law and Society' curriculum does not intend to provide a kind of legal education or juvenile delinquency prevention but a part of civic education which emphasizes to increase legal ability needed to democratic citizens. Yet 'Law and Society' curriculum does not limit quantities of learning contents adequate to civic education. Second, Furthermore scopes and sequences of 'Law and Society' curriculum are very ambiguous and inconsistent between units. Ambiguity and Inconsistency of scope and sequence between units are very serious problem. Because concrete fields of study and accumulation of knowledge in the jurisprudence are very vast. Third, 'Law and Society' curriculum does emphasize case method approach as techniques for teaching law which uses concrete real legal cases, not factual knowledges about jurisprudence. Yet the basic purport of 'Law and Society' curriculum is not reflected in developed textbook. Possibly these problems of 'Law and Society' curriculum and textbook eventually will cause confusions in social studies classroom. And 'Law and Society' may be a troublesome course of study in social studies to students and teachers.
