원내교섭단체 요건 및 지위의 변화 필요성과 실천전략: 의석수와 정당득표율을 중심으로

초록
본 논문은 논쟁의 여지는 충분히 있지만 우선 교섭단체의 실체를 전제로 하고, 그 구성요건 및 지위를 어떻게 할 것인가에 연구의 초점을 맞추고 있다. 즉 원내교섭단체 구성요건 및 지위를 어떻게 해석하고, 현실을 변화시키는 경우 어떤 방식으로 하는 것이 합리적인 가에 대해 탐구하고 있는 것이다. 구체적으로 본 논문은 먼저 교섭단체의 개념적 정의와 정치적 권리를 살펴보고 있다. 둘째, 교섭단체의 구성요건과 관련된 논쟁을 찬반양론으로 구분하여 제시하고 있다. 셋째, 교섭단체의 구성요건, 조직, 운영실태의 세계적 추이를 살펴보고 있다. 넷째, 한국에서 교섭단체 구성요건의 변화추이를 국회법 개정을 중심으로 개관하는 동시에 원내교섭단체 구성요건과 그 정치적 영향을 대통령제, 소선거구제, 그리고 신당의 출현 등의 측면에서 파악하고 있다. 마지막으로 이상의 작업을 토대로 교섭단체 구성요건을 변화시키는 경우 이의 구체적인 전략을 제시하고 있다.이러한 분석을 통해 본 논문에서는 원내교섭단체 구성요건 및 지위를 둘러싼 이론적·현실적 공방을 충분히 검토하고, 이들 주장이 각각 타당성이 있음을 강조한다. 아울러 본 논문에서는 교섭단체 폐지론까지 주장되고 있는 현재의 혼란을 최소화시킬 수 있는 하나의 길이 교섭단체의 요건과 지위를 확보할 수 있는 원칙과 기준인 ‘의석수’와 ‘정당득표율’이라는 사실을 강조하며, 이의 구체적인 적용방안을 제시하고 있다.
Abstract
This paper explores a feasible strategy that can change the requirement of the congressional party group and its political and financial benefits in Korea. In order to accomplish this objective, this paper first examines the historical changes that has occurred in the requirement of the congressional party group in Korea and compare its requirement with other countries. Second, this paper analyzes the political and financial benefits of the congressional party group in Korea in detail. Third, this paper emphasizes the importance of changes in the requirement of congressional party group for a political reform in Korea. Finally, this paper suggests a feasible strategy that can change the requirement of the congressional party group and its political and financial benefits. In specific, this paper emphasizes 'the number of congressional seats' as a critical criterion for the requirement of the congressional party group. In addition, 'the polling rate of political party' in a latest congressional election as an important criterion for the legal status of the congressional party group to receive political and financial benefits is emphasized.
