플라톤의 정치가에서 정치체제와 법률

초록
이 논문은, 지식에 의거한 최선의 통치나 정치체제 이외에, 법률을 토대로 하는 정치체제들의 경우, 그 법률은 ‘현실적인 법률’이 아니라 ‘이상적인 법률’이어야만 한다는 사실을 밝힌다. 이때 ‘이상적인 법률’은 진리 자체는 아닐지라도 진리에 가장 근접한 ‘훌륭한 법률’이다. 이를 논증하기 위해 이 논문은 『정치가』300c5-8의 해석을 토대로 이 대화편에서 논의된 ‘법률’과 ‘정치체제들’에 대한 언급들을 분석한다. 플라톤은 ‘현실적인 법률’에 기초한 정치체제들을 배제하려 하는데, 이는 ‘현실적인 법률’이 대중이나 의회에서 제정된 것들로 지식을 결여한 ‘훌륭하지 않은 법률’이기 때문이다. 하지만 이런 정치체제들을 배제하더라도, 현실적으로 참된 지식을 지닌 왕도적 치자에 의한 통치가 실현되기 힘들다면, 차선으로 ‘이상적인 법률’을 토대로 한 정치체제가 긍정적으로 생각될 수 있다. ‘이상적 법률’은 대중이 아닌 ‘참된 치자’의 입법행위에 의해 제정된 것으로 완고하게 법률을 지켜야만 하는 것은 아니다. 따라서 ‘이상적 법률’은 참된 치자의 행위를 모방한 법률을 가리킨다. 만일 그런 법률의 제정이 가능하다면, 그 법률을 토대로 한 정치체제는 이상적인 왕도적 정체에 버금가는 차선의 것일 수 있다. 바로 이런 인식이 플라톤으로 하여금 말년의 대작인 『법률』을 저술케 한 것 같다.
Abstract
This Paper makes clear that except for best rule or constitution with knowledge, in case of law-bound constitutions, the laws must not be ‘existing laws’ but ‘ideal laws’. ‘Ideal laws’ are good ones which are not truth itself but most approximation to truth. Arguing this, this paper analyses the remarks for ‘laws’ and ‘constitutions’ in Statesman according to interpretation of Statesman300c5-8. Plato excludes the constitution with ‘existing laws’. Because ‘existing laws’ may be bad ones without knowledge which are legislated by multitude or assembly. But though excluding these constitutions, if it is really difficult to accomplish rule of ideal Ruler with knowledge, the constitution which is based on ideal laws, that is, second-best one is positively considered. ‘Ideal laws’ are legislated by the legislating activity of not multitude but true statesman, and ones which must be rigidly stick to laws. So ‘ideal laws’ refer to the laws which imitates activity of true statesman. If it is possible legislate such laws, the constitution with such laws is second-best one similar to ideal constitution. That is what permits the writing of the Laws which is a sketch of a philosophically based legal system.
