중국의 법률서비스시장개방 및 한국의 문제점

중국의 법률서비스시장개방은 1992년부터 시작되었다. 2005년 중국 사법부의 공고에 의하면, 현재 139개의 외국 법률사무소 주중대표처와 43개의 홍콩법률사무소 주중대표처가 중국에 설립되어 있다. 현재 중국은 한국의 최대의 무역교역국이며 최대의 자본투자국이다. 한국의 법률시장개방은 눈앞에 다가오고 있으며, 사법고시 합격자 ‘1000명 시대’는 이미 시작되었다. 한국의 법률업계에 있어서 중국진출은 거스를 수 없는 대세다. 그러나 한국은 중국의 법률서비스시장진출에 매우 소극적인 자세를 보이고 있다. 여건이 아직 성숙되지 않았다는 이유로 중국진출을 미루고 있다. 현재 중국에 진출한 한국 법률사무소는 3개밖에 되지 않으며 그나마 모두 근년에 진출한 것이다. 저자는 본문에서 한국의 중국 법률서비스시장진출은 더 이상 미룰 수 없다고 판단하고 한국 법률업계의 적극적인 진출을 권장하고 있다. 현재 중국의 법률사무소들은 개혁을 진행하고 있으며 베이징, 상하이 등 지역의 법률사무소들은 눈부신 발전을 가져오고 있다. 외국 법률사무소와 홍콩 법률사무소들은 몇 년 전 심지어 10여 년 전부터 중국에 진출하여 경쟁력을 키우고 있다. 게다가 중국의 구체적인 상황으로 말미암아 중국 법률서비스시장의 전면개방은 아직 이른 것으로 판단된다. 더 이상 진출을 늦춘다면 한국은 중국의 법률서비스시장에 진입할 기회를 상실하게 된다. 본문은 주로 다섯 개 부분으로 구성되어 있다. 제1부분은 서론이고 제2부분은 중국의 법률서비스시장개방관련 규정에 대한 소개이다. 제3부분에서는 중국 사법부가 2002년부터 2005년까지 발표한 공고에 대한 분석, 정리를 통해 중국에 진출한 법률사무소들의 현황분석을 하고 있다. 제4부분에서는 한국의 중국진출현황을 소개하고 중국진출을 서둘러야 하는 필연성을 열거하고 있다. 제5부분은 결론이다.
Abstract
The law service market opening in China began in 1992. According to the public announcement by China Judicature Department in 2005, 139 foreign law offices and 43 Hong-Kong law offices have been founded in China currently. China is currently a maximum trade trading and capital-investing nation to Korea. The Korean law market service opening is approaching. It is the high time that one thousand qualified candidates should be examined. Korean law service launching into China has become a trend. However, Korea shows negative attitude at the law service market launching into China. Korea has postponed the launching for the reason that the condition has not matured yet. According to the public announcement of China judicature, only three Korea law offices that have mounted the area in China recently. The writer argues that Korea law service market launching into China cannot be postponed any more provided it wants to give up. Law offices of China are progressing currently the reform. Beijing, Shanghai, and other local offices are bringing brilliant development. The foreign and Hong-Kong law offices mounted the area 10 years ago in China and they are enlarging their competitive power. If the launching is postponed again, Korea will surely lose the penetration opportunity of law market service in China. The article includes five parts. The first part is the introduction. The second part introduces Chinese law service market with concerned policies and regulations. The third part analyzes the announcement claimed by China Judicature Department from 2002 to 2005 as well as introduces the current situation of foreign and Hong Kong law offices in China. The fourth part introduces the situation of Korean law offices' launching into China as well as the launching reasons. The fifth part is the conclusion.
