홍콩의 組織犯罪에 관한 고찰

초록
"사회 있는 곳에 범죄 있다"는 말처럼 어느 국가 또는 사회든 범죄가 없을 수는 없다. 그런데 그러한 범죄 중 더욱 관심을 끄는 것은 조직범죄이다. 이는 집단적 위력을 배경으로 가공할 정도의 사회적 위험성을 갖고 있어서 일반 서민들의 생활에 큰 위협이 될 뿐만 아니라 국가, 사회를 부패시키는 등 그 해악이 크기 때문이다.홍콩의 범죄조직이 활동을 한 역사적 기원은 오래되어 홍콩주민의 일상생활에 많은 영향을 주어왔으며, 최근에는 국제적 규모로 확대되어 국제적 범죄를 행하고 있는 바 세계적으로 큰 비중을 차지하고 있다.홍콩의 범죄조직하면 우선 홍콩의 '삼합회'를 거론하지 않을 수 없다. 본 논문은 홍콩의 조직범죄에 대하여 그 발생과 변천과정을 살펴보고 최근의 주요 조직현황과 그 대책에 대하여 고찰해 보았다. 우리는 이를 통하여 범죄조직은 끊임없이 환경에 적응하며 스스로 생존.발전을 모색한다는 것을 알 수 있다.따라서 조직범죄에 대하여는 단속과 제재의 끈을 조금이라도 느슨하게 해선 안 될 것이며 조직범죄의 특성을 감안하여 조직범죄근절을 위한 특별대책법을 제정시행해야 할 것이다. 홍콩의 사단조례(社團條例)는 삼합회에 대한 처벌근거, 몰수규정, 신고자에 대한 보호규정, 삼합회조직원에 대하여 삼합회조직탈퇴를 유도하기 위한 특별면책규정 등을 규정하고 있는데 이러한 규정은 우리나라의 유관기관에서도 참고할 만한 것이라고 할 것이다.
Abstract
Just as the saying that “where there is a society, there is a crime,” there exist crimes in every nation and society. Among those crimes, the organized crime causes more attention than any other ones. This is because it contains the annihilating power to threaten the society with its collective power and it not only puts the life of people at risk, but also corrupts a nation and a society and so on, its harm is beyond description. The history era of organized crime in Hong Kong is long and organized crime in Hong Kong have given a many effect in daily life of the Hong Kong residents. Recently it expanded into an international scale and does an international crime. So it hold a world-wide big specific gravity. About organized crime in Hong Kong we cannot help making ‘The Triad’ a subject of discussion. At this paper I looked into the occurrence and the processes of change. In addition I studied recent state of primary organized crime in Hong Kong. In the conclusion I studied the measure against the organized crime. Through this study we are able to know the fact that organized crime group continuously adapts itself to the circumstances and gropes for survival and expansion. Consequently we must regulate the organized crime, and taking its characters into consideration, establish the special countermeasure law which can exterminate the organized crime. The Corporation act of Hongkong is prescribing the punishment-basis, confiscation-provisions, protection-provi- sions for reporter, special immunity-provisions to lead the withdrawal form the Triad for the members. These provisions are worth taking into consideration for the scholars and the relevant authorities in Korea.
