중국형법상 형벌의 종류에 관한 연구

초록
중국의 형사법체계는 우리나라와 비슷한 점이 있으면서도 나름대로 독특한 특징을 보여주고 있다. 특히 형벌체계에서 그 특징이 두드러진다고 볼 수 있다. 중국의 형법총칙 제3장에서는 중국의 형벌에 대해 규정하고 있는데 중국의 형벌은 주형과 부가형으로 나눌 수 있다. 주형에는 관제(官制), 구역(拘役), 유기도형(有期徒刑), 무기도형(無期徒刑) 그리고 사형이라는 5가지 형종이 있고, 부가형에는 벌금, 정치권리박탈 그리고 재산몰수가 있다. 관제는 범죄인을 수감하지 않고 공안기관이 그에 대해 일정한 자유를 제한하는 형벌이며, 구역이란 범죄인의 인신자유를 단기간 박탈하는 형벌로서 주거지 인근에서 집행하며 '노동개조(勞動改造)'를 실시한다. 유기도형과 무기도형은 우리나라의 유기징역, 무기징역과 유사한 형벌이다. 중국에서 사형은 즉시 집행하는 경우와 2년간 사형집행을 유예하는 경우로 나누어 볼 수 있다. 정치권리박탈은 범죄인이 국가의 행정 또는 정치활동에 참여할 수 있는 권리를 박탈하는 형벌을 말하며, 재산몰수는 범죄인 개인이 소유하는 재산의 전부 또는 일부에 대하여 무상으로 국가에 강제적으로 귀속시키는 형벌이다. 한편 죄를 범한 외국인에 대하여는 강제로 국경 밖으로 떠나도록 하는 추방이라는 형벌을 부가형으로 실시하고 있다.
Abstract
A Study on the Sort of Punishment in China In this article I treated the sort of punishment in China. The contents of this article is as follows; Ⅰ. Introduction Ⅱ. Principal Penalty 1. public surveillance 2. criminal detention 3. fixed-term imprisonment 4. life imprisonment 5. death penalty Ⅲ. Additional Penalty 1. fine 2. deprival of political rights 3. property-forfeiture 4. deportation. Ⅳ. Conclusion The punishment of China is divided into principal penalty and additional penalty. As a principal penalty there are public surveillance, criminal detention, fixed-term imprisonment, life imprisonment and death penalty. As a additional penalty there are fine, deprival of political rights, property-forfeiture and deportation. In comparison with chinese punishments there are not public surveillance, death sentence with a two-year reprieve and forced labour and deportation. I think that it is useful for us to introduce the death sentence with a two-year reprieve and forced labour.
