수입화물선취보증서제도의 개선을 위한 e-L/G의 활용에 관한 연구

초록
근거리무역의 비중이 큰 국내의 경우 L/G에 의한 화물인도는 무역업계와 해운업계 모두에 이익을 줄 수 있는 제도로서 그 필요성이 더욱 강조된다. 그러나 국내법의 규정에 의하면 위법행위로 간주되어 운송인에게 화물인도에 따른 책임을 부담하고 있다는 점, L/G의 위조사건으로 인하여 은행에 건별로 조회하는 복잡한 진위 여부를 확인하여야 한다는 점, L/G의 내용에 은행의 책임부담의 문언이 불명확하다는 점 및 복잡한 절차로 인하여 화물인도에 상당한 시간이 소요되고 있다는 점 등은 L/G의 유용성과 신뢰성을 저해하는 요인이 되고 있는 것이 사실이다. 이에 L/G에 의한 화물인도업무 프로세스의 개선을 위하여 무역업무 자동화를 주도하고 있는 KTNET이 자사의 기존 데이터베이스 시스템인 MFCS를 활용하여 은행과 선사가 연계되어 L/G의 신청, 발급, 조회, 확인 등의 L/G와 관련된 모든 제반 서비스를 관계당사자에게 제공하는 e-L/G 서비스를 2003년 9월부터 개시하고 있다. 이러한 e-L/G를 통한 L/G의 전산화는 현재 활발히 추진되고 있는 D/O의 전산화와 더불어 향후 전자식 선하증권(electronic bill of lading: e-B/L)과 전자결제까지 연계된 국내물류에 있어서의 소위 ONE-STOP 서비스를 제공할 수 있는 중요한 전기가 마련된 것으로 큰 의의를 가진다.
Abstract
Nowadays because of the development of transport technology, the import goods may arrive at the port of destination prior to the shipping documents. In such situation, the carrier used to deliver the goods to the importer against the Letter of Guarantee(L/G). L/G has been established as a trade practice for about 50 years. But L/G system has problems such as the illegality of L/G based on the Commercial Law, the forgery of L/G and procedural complexity. So to improve the L/G system, Korea Trade Network(KTNET) developed the new service called electronic Letter of Guarantee(e-L/G) using EDI system, This paper examined two different system, paper-based L/G and e-L/G using EDI system. Firstly, the concept and the necessity of L/G system and the problems of the paper-based L/G were examined. Also how the importer could take delivery the import goods from the carrier using the e-L/G system developed as an improvement of the traditional L/G system was examined. The e-L/G system has lots of merits compared with the paper-based L/G. This paper recommends that the traders and the carriers should use e-L/G system for the common benefit in the field of trade and transport.
