결론내리면 단독중재인은 본건에 대하여 비엔나 협약을 적용할 수 있다고 결정한다. 그리고 동 협약이 법률의 자격으로 적용될 수 있다는 것은 1955년 헤이그 협약에서 표명되어진 저촉법규칙은 이탈리아법을 지정하고 있으며 그 이태리법은 비엔나 협약 비준후에 이 조약 규정을 국내법에 편입했기 때문이다. 이 문맥에 있어서는 계약상 비엔나 협약의 명시적 선택은 동 협약에 법률의 성격을 잃지 않게 하였다.」③ 판정의 의의이 중재판정에 있어서, 중재인은 비엔나 협약 제1조 1항 b호의 요건이 충족된다는 이유로 동 협약의 적용을 인정하고 있다. 그 규정은 ‘국제사법의 준칙이 혹은 체약국의 법의 적용을 인도하는 경우’ 에 동 협약의 적용을 인정하고 있지만 이 중재판정은 그 ‘국제사법의 준칙’ 의 내용으로서 관련국의 국제사법 준칙의 누적적 적용을 시도하고 그리고 본건에 관련되는 이탈리아와 핀란드의 국제사법 준칙이 모두 이태리법 적용을 이끌어낸다는 것 그리고 이탈리아는 체약국이며, 동 협약을 비준할 때에 어떠한 유보도 표명하지 않았음을 인정한 것이다. 이 때 동 협약이 이탈리아 ‘국내법에 편입’ 된 것으로 하여 적용한다는 것이 표시되어 있다. 그런데 이 중재판정은 동 협약의 제1조 1항 a호의 요건이 충족되어 있음을 지적하고 있다. 그리하여 동 협약을 적용하기에 충분하다고도 생각된다. 그러나 중재판정은 아마 당사자의 영업소가 소재하는 체약국인 이태리와 핀란드중 후자인 핀란드는 동 협약의 제2장(계약의 성립부분)을 유보하고 있다는 사실을 중시하여, 동 협약 제1조 1항 a호에 따라 동 협약을 전체적으로 적용할 수 없다고 생각한 것은 아닐까.攀 Cf. y. D., Note, Clunet 1995, p. 1021攀攀 덧붙여 이 중재판정은 당사자에 의한 비엔나 협약의 지정에는 저촉법상 지정의 의의가 인정되어 있지 않다는 것을 유의하여야 한다. 또한 명확하지는 않지만, 전체로서는 비엔나 협약의 적용요건이 충족되어 있으면 그것을 직접 적용한다는 태도를 제시한 것으로도 볼 수 있다.
Abstract
ICC rules of arbitration and application of CISGSung, Seong-JeThe International Chamber of Commerce(here in after 'ICC') established the ICC International Court of Arbitration(ICC Court). The fundamental characteristics of the ICC rules of arbitration(ICC rules) are the universality and adaptability of the ICC rules most of all legal systems. The parties are allowed considerable autonomy in connection with the establishment of the arbitral tribunal. They are free to agree on the number of arbitrators and to designate arbitrators of their choice. Under certain circumstances, arbitrators are appointed by the ICC usually with the assitance of the national committees. The ICC Court has broad powers to replace arbitrators for lack of independence. ICC Court shall do its possible to apply UN Convention on Contracts for the International Sale of Goods(CISG). So we should have to know the application of CISG. Especially, the CISG came into effect in 2005 because the National Assembly ratify the CISG.
