U-City의 건설과 관련, 컴퓨터 시스템의 발전으로 인하여 정보의 저장, 분석량이 많아지고, 민감한 개인정보를 다루는 컴퓨터에 의한 개인정보의 침해에 대한 우려가 발생함에 따라 개인의 기본권이 위협받고 침해당할 수 있는 부분, 특히 개인의 프라이버시와 정보보호, 정보통제와 관련한 부분에 있어서는 충분한 법제도적인 준비가 이루어지지 않는 상황이다. 개인의 프라이버시 혹은 정보보호의 문제는 비단 U-City의 경우에만 국한하여 발생하는 것이 아니라 유비쿼터스 컴퓨팅 환경(Ubiquitous Computing Environment)이 구현되는 모든 사회영역에서 발생할 수 있는 문제일 것이나, U-City는 이러한 차세대 유비쿼터스 환경의 총 집약체인 점에서 그 영향력과 파급력이 다른 영역에 비할 수 없이 크다. 특히 개인의 일상생활, 근로활동 등 모든 개인활동이 도시에서 이루어지는 현대사회에서 개인의 24시간이 유비쿼터스 컴퓨팅 기술에 의해 통제되는 U-City의 건설은 그 장점뿐만 아니라 역효과에 관하여도 심도 있는 검토와 법제도적인 준비가 뒤따라야 할 것이다. 따라서 개인정보보호와 관련하여 U-City사업의 추진은 개인정보에 관한 영향력과 파급효과가 광범위하고 막대하므로, 기존의 개인정보보호법제 혹은 지금 도입이 논의 중인 일반적인 개인정보보호법제만으로는 규율에 흠결이 발생할 소지가 크다. 결국, U-City의 구현에 있어서는 그에 상응하는 사전적 예방적 제도의 마련이 필수적이며, 정보의 수집에서 폐기에 이르는 유통과정에 있어서도 그 특수성을 충분히 감안하여 적절한 대응방안을 모색해야 할 것이다.
Abstract
U-City(that is short for the ubiquitous city) is where all major social systems(including Transportation, residential, medical, etc) share data by connecting to the ubiquitous computing network. Citizens can always connect to network anywhere, anytime in the city. And in Korea, numerous U-Cities are under construction based on the Korea's economy masterplan, IT839. But this U-City project is also a controversial idea that raises privacy concerns. Because Ubiquitous powered city will have the potential to create an even more invisible and dangerous surveillance network covering an unprecedented share of our public and private life. Ubiquitous computing service is no more privacy neutral. Development of Ubiquitous computing technology have hugely increased the possibilities for invasions of privacy by governments, corporation, and individuals. For that reason, in this paper, I introduce the way of improving various laws and regulations about privacy under ubiquitous computing environment in such a way to meet the realistic needs of civil privacy. First of all, privacy-respecting ubiquitous computing system that reflects basic principles of protection of personal information is required when proceeding this U-City project to prevent invasion of privacy. And also, introducing of PIA(Privacy Impact Assessment) is highly recommended. And various preventive measures that can regulates the possibilities for invasion of privacy should be taken.
