중국의 제헌운동이 상해 임시정부 헌법제정에 미친 영향:

본 논문에서는 1911년 신해혁명 이래 중국 각지에서 제정된 헌법문서들이 1919년 상해에 수립된 대한민국 임시정부의 헌법문서에 미친 영향을 분석하였다. 그 결과 다음과 같은 사실들을 발견할 수 있었다. 첫째, 조소앙의 주도로 제정된 1919년 4월 11일의 ‘임시헌장’에는 중국측 헌법문서의 영향력이 그다지 크지 않으며, 오히려 조소앙의 ‘삼균주의’와 같은 우리 고유사상의 영향력이 두드러지게 나타나고 있다. 둘째, 신익희의 주도로 제정된 1919년 9월 11일의 ‘임시헌법’은 중국측 헌법문서, 특히 1912년의 ‘중화민국임시약법’ 1913년의 ‘천단헌법초안’ 1914년의 ‘원세개헌법’ 등의 영향력이 강하게 나타나고 있다. 다만, 위 세 가지 중국측 헌법문서의 각기 다른 규정내용을 취사선택하는 과정에서, 신익희는 그 자신의 정치적 의도를 실현하고 당시 임시정부의 현실적 여건을 고려했던 것으로 보인다. 셋째, 상해임시정부의 헌법제정 및 헌정운영 경험은 대한민국 건국 이후 1948년 헌법의 제정과정에서 적잖은 영향력을 행사하였으며, 결과적으로 당시 중국측 헌법문서는 상해임시정부의 헌법문서를 통하여 간접적으로 우리 헌법의 제정과정에 영향을 미친 것으로 판단된다.
Abstract
I make a comparative study about how the constitutional documents of China since its 1911 Revolution influenced on the Korean Constitutionalism during Shanghai Provisional Government. Through the study, I clarify below three things. First, Cho So-ang played a leading role to establish the Provisional Charter of 1919. 4. 11. and he put his thought of Samgyun into the Charter. So, the constitutional documents of China have just a little influence on the Charter of 1919. 4. 11. Second, the Provisional Constitution of 1919. 9. 11. established by Shin Ik-hee was strongly influenced by the constitutional documents of China such as Provisional Constitution(1912), Tiantan Draft Constitution(1913), Yuan Shikai Constitution(1914). Nevertheless, in adopting some provisions, Shin Ik-hee embodied his own political intention considering the realities of the Provisional Government. Third, the experiences of constitutionalism in 1919 influenced on the establishment of Korean Constitution in 1948. As a result, the constitutional documents of China affected the es- tablishment of Korean Constitution through the constitutional experiences during Shanghai Provisional Government.
