민주주의와 헌정주의의 갈등과 조화: 미국헌법 해석에 있어서 원본주의(Originalism) 논쟁의 의미와 역할

근대 이후 민주주의와 헌정주의 두 정치원리의 가치를 부인할 사람은 아무도 없다. 그러나 이 두 원리의 상호관계는 사뭇 복잡한 양상을 보이고 있 어서, 때로는 하나의 원칙이 다른 원칙의 희생을 요구하는 상황이 벌어지기도 한다. 본 논문은 원칙적으로 갈등할 수밖에 없는 헌정주의와 민주주의가 어떻게 갈등의 정도를 완화하고 상대적인 안정을 유지할 수 있는가라는 문제의식으로부터 출발한다. 이런 문제의식을 바탕으로 필자는 미국적 맥락에서 관찰되는 민주주의와 헌정주의의 동학을 검토한다. 미국 헌정사에서도 두 정치원리의 긴장과 갈등은 여전히 존재한다. 그러나 본 논문이 주목하고 있는 것은 왜 미국에서는 헌정주의와 민주주의 두 정치 원리가 상대적으로 안정적 균형상태를 유지하고 있느냐 하는 점이다. 논문은 그 이유를 원본주의(originalism) 논쟁에 바탕을 둔 미국 헌정주의 논 의구조의 특수성에서 찾는다. 본 논문의 2장은 다소 생소한 개념인 원본주의와“살아 있는 헌법”이론의 등장배경과 진화과정을 밝히고 3장은 그 사상적 토대를 비판적으로 검토한다. 이를 통해 본 논문은 원본주의를 둘러싼 독특한 논쟁이 미국 헌정주의의 독자적 영역을 확보하는데 기여하였고, 아울러 민주주의와 헌정주의 간의 갈등을 완화시키는 역할을 하였다는 점을 밝힐 것이다. 헌정주의와 민주주의의 상호관계에 대한 미국적 맥락을 이해하는 것이 곧바로 두 원리의 갈등을 근원적으로 해소할 수 있는 보편적 해결책이 될 수는 없다. 하지만 본 논문 의 의의는 일반이론을 향한 비교적 관점을 제공할수 있다는 점에서 찾을 수 있다고 본다.
Abstract
Both constitutionalism and democracy are indelible political principles in our political arena. Modern political history exhibits that both principles were achieved only through enormous efforts and struggles of democratic citizens. However, the two principles may contradict each other especially when the one is overemphasized even to demand sacrifice of the other. The paper begins with the awareness of the potential conflict between constitutionalism and democracy, and asks how the conflict between the two political principles may be mitigated. As an initial step to answering to the question, the paper examines American context where constitution and democracy coincide only in a moderate way. In principle, constitution and democracy also in the American context coincide but they do not in a catastrophic way. The paper finds the cause in the specific context of American constitutionalism, which revolves the debates over originalism. The paper introduces development of originalism in American constitutional history by relating it to theory of living constitution. In addition, the paper examines fundamental bases of each theory from a critical perspective. In doing so, the paper argues that the theory of originalism helps constitutionalism establishing its autonomous space in American political arena and this space plays significant role of relieving the conflict between constitutionalism and democracy. This study does not provide universal solution to the conflict between the two principles but it provides a comparative perspective for finding more general solution to the conflict.
