공영방송 수신료의 헌법적 의미

이 논문은 이원적 공영ㆍ민영 방송모델을 취하고 있는 독일연방헌법재판소 결정이 방송수신료 문제를 해결하는 데 적용될 점은 없는지 검토하는 데서 출발하였다. 방송모델을 결정할 자유는 입법형성의 자유를 가진 입법자에게 있지만, 공영방송을 법적으로 인정한 이상 입법자는 공영방송 고유의 기능에 필요한 재정을 위한 재원보장의무를 가진다. 왜냐하면 방송수신료는 프로그램의 자율성과 중립성을 확보하기 위한 재원이 될 뿐만 아니라 방송 고유의 기능을 위해 필수불가결한 재원이기 때문이다. 그런데 입법자는 방송의 자유를 위한 법질서 형성의무를 부담하면서도 방송의 자유에 위험원이 될 수도 있다. 따라서 입법자는 투명성이 확보되는 사전예방적인 절차법적 보장을 해야 할 헌법상 의무를 진다. 이것은 방송수신료를 산정하고 결정함에 있어 경제성을 고려할 능력이 있으면서 입법자 자신의 영향력 행사로부터도 독립된 전문위원회를 구성하는 등의 절차법적 보장을 할 의무를 진다는 것을 의미한다. 현행 통합고지방식은 공영방송 고유의 기능을 상실할 위험 및 시청자의 알 권리와 징수방법으로 인해 침해되는 시청자의 재산권 및 평등권, 행복추구권을 형량해 볼 때 전국적인 시청료 거부가 있기 이전까지는 헌법상 비례의 원칙을 심각하게 침해한 것으로 보이지 않는다. 다만 방송수신료 재원이 확보된 이후에는 시청자의 선호를 반영한 징수체제로 전환해야 할 것이다. 오히려 현행 방송수신료는 입법자가 절차법적 보장을 제대로 못하고 있다는 데 그 위헌성이 크다. 이번 헌법소원심판을 계기로 헌법재판소는 헌법상 입법자에게 부여된 절차법적 보장의무를 확인하고, 입법자는 절차법적 보장의무를 이행함으로써 진정한 방송개혁으로 이어져 국민의 사랑을 받는 KBS로 거듭나길 기원한다.
Abstract
This Study aims to resolve constitutional problems of the public broadcasting’s receiving fee. The public broadcasting’s receiving fee means a public fund for guaranteeing the program’s autonomy & neutrality against the Government, sponsors and so on. And it means also a public fund for the original function of public broadcasting. The decision of the Federal Constitutional Court in German about the receiving fee is presented for the example in this article. Lawmaker has Freedom of settling a model for the broadcasting system. But Lawmaker has also Obligation of providing the public broadcasting with the funds for original broadcasting function, because it has accepted the public broadcasting system. Lawmaker legislates for Freedom of broadcasting, but Lawmaker itself can be also a dangerous source against Freedom of broadcasting. Therefore Lawmaker must legislate the clear procedural law by way of prevention. Lawmaker should set independent Commission for the Assessment of the Financial Requirement. This Commission must be also independent of Lawmaker itself. The Korean Constitutional Court should require Lawmaker to legislate the clear procedural law.
