정보통신서비스중독에 대한 법적 대응

초록
우리나라는 세계최고수준의 인터넷 인프라를 구축하고 비교적 낮은 가격으로 종량제를 채택하여 인터넷의 실질적 활용에서는 세계적으로 가장 앞서가고 있다. 그러나 그 이면에는 다양한 종류의 부작용이 발생하고 있으며, 과다한 인터넷 이용으로 인해 이용자 자신에게 부정적인 영향을 끼치는 인터넷중독도 그 중 하나이다. 2005년 이루어진 인터넷중독 실태조사의 결과에서 나타나듯 다른 나라보다 일찍 그리고 보다 심각하게 정보통신서비스 중독이 사회적인 문제로 부각되었으며 시간이 갈수록 심각한 양상을 보일 것으로 예상된다.따라서 국가적인 차원에서 법제도의 마련은 지금이 가장 시의적절한 시점이라고 생각된다. 그 제안으로 ‘(가칭) 정보통신서비스중독 예방 및 해소에 관한 법률’을 제정하여 국가, 정보통신서비스제공자 그리고 이용자의 3자의 긴밀한 협력을 통해 정보통신서비스중독 문제를 해결하는데 노력하여야 할 것이다.그 구체적인 기본원칙으로는 ① 이용자의 자율적인 중독여부 판단과 규제, ② Shut- down제도의 부인, ③ 정보통신서비스제공자의 협력강제의 원칙을 들 수 있다. 그리고 법률을 통해서 구체화할 정책으로는 국가 및 지방자치단체가 정보통신서비스중독을 예방하고 해소하는데 책무가 있음을 밝히고, 정보통신부 산하 한국정보문화진흥원을 전담기관으로 지정하고, 정보통신서비스중독 예방을 위해 고지절차를 둘 것을 제공자에게 의무화하고, 이용자가 스스로 결정한 이용패턴을 등록하면 그것을 준수할 수 있는 기술적 조치를 제공할 것을 제공자에게 의무화하여야 할 것이다. 다만 청소년의 경우에는 자신의 의사가 아닌 법정대리인의 의사에 의해 정보통신서비스 이용패턴이 결정되어야 할 것이다. 끝으로 이러한 조치를 이행하지 않으면 시정명령을 발할 수 있도록 하고 그 시정명령을 준수하지 않는 경우에는 과태료를 부과하여 실효성을 확보하여야 할 것이다.
Abstract
Korea is one of the most informatizationed nations in the world. Internet infrastructue and broadband interntet with reasonable price can make the surrounding of that. However Korea is suffering some side-effect of informatization, especially internet addiction that give a negative effect to internet heavy users. According to 2005 survey for the actual conditions of internet addiction by KADO, internet addiction become a serious social matter nowadays. The best legal measure for internet addiction is to legislate "Act on prevention and solution for telecommunation service addiction". Government, telecomunication service provider and user should work in clese cooperation to prevent and solve internet addiction problem.The principles of this Act should be ① self-control of internet user, ② denial of shut-down measure, ③ compulsive cooperation of telecommunication service provider with user's self-reguration. The telecomunication service provider should provide notice procesure preventing internet addiction to users and give a control service to cease internet connection after the time by deciding user's self-regulation. But for the young people, the guardian can decide a pattern of internet use of his youth and the telecomunication service provider obey this decision.
