토지거래허가에 관한 형사법적 문제

There are much more needs for real estate including land than the supply of real estate in the korean society nowadays. For this reason more complicated types and amounts in the deal of real estate are increased. To solve this problems many real estate related laws are made, especially Act on special measures for the Registration of Real Estate and National Land Planning and Utilization Act. Act on special measures for the Registration of Real Estate and National Land Planning and Utilization Act are the laws that regulate to prevent raising landprices high abnomally and obtain real estate ownership for real landdemander in the land market. In the Act on special measures for the Registration of Real Estate, application of Registration of Real Estate is obliged to be made within certain days from day of landsalecontract and real cause of Regisration is obliged to be booked in the Real Estate Register to obtain real estate ownership through landsalecontract. If not, one would be purnished by this law. And in the Land Planning and Utilization Act Permission for landsaledeal is introduced to permit real landdemander to obtain real estate ownership in the region of Permission for landdeal. Though landsalecontract is made between the both parties of landsalecontract, landsalecontract will have effect through obtainment of Permission for landdeal. But unforseenably it is occurred that these two laws including criminal law are conflicted one another at several points through practices of these laws. On these reasons this article will be studied on the criminal problems on the Permission for landsaledeal including the inconsistency between these laws and criminal law.
