This paper demonstrates that the emergence of the PSI is the result of the ineffectiveness of current international law order. While new security threats such as the increased threat of the terrorism and problem of the rogue states appeared, sovereign state based international order failed in adjusting itself to the new security environment in the world community. Another example of the limitations of the international order can be also found in the problem of ineffectiveness of current international WMD control treaty system. The fact that efforts to prevent the transfer and/or movements of the WMD in the sea are frequently not allowed due to the principles of the law of the sea also demonstrates the limitations of the international law which led to the birth of the PSI. Finally it is important to note that the PSI is not the product of the unilateralism of the US, the sole hegemon in the post Cold War ear, to replace the international law order, but of the US's hegemonic role in reforming international law order to address the newly emerging security threats to the world community.
