WTO의 TRIPs 협정의 발효에 따라 국가별 지적재산권 보호 수준의 차이에 대한 관심이 증가하고 있다. 특히, 국가별 보호 수준의 결정요인에 대한 분석은 지적재산권 보호에 관한 국제적 논의에 대하여 중요한 시사점을 제공한다.본 연구는 Ginarte & Park(1997)의 1995년과 2000년 국가별 지적재산권 보호 지수를 이용하여 국가별 지적재산권 보호 수준 결정요인을 분석하였다. 그 결과 경제개발 수준과 보호 수준 사이에 정의 관계가 존재하지만 그러한 관계는 경제개발 수준이 일정 수준 이상인 경우에 나타나고 있어서 둘 사이의 관계가 U자 형태임을 확인하였다. 또한, 지적재산권 보호 수준 선택에 기술개발 능력과 소유권 보호 정도와 같은 제도적인 요인이 영향을 미치고 있음을 알 수 있었다.이러한 결과는 지적재산권의 보호에 대한 국제적 논의에 있어서 후진국의 입장을 고려해야 할 필요성이 있다는 것과 지적재산권 관련 연구에서 보호 수준과 경제개발 수준 사이의 관계를 명시적으로 고려할 필요성이 있음을 의미한다.
Abstract
After effectuation of WTO's TRIPs agreement, interest in the difference of cross-countries intellectual property rights(IPRs) protection has been increased. Therefore, in international discussion on IPRs protection, it has significant implication to investigate the determinants of cross-countries IPRs protection.In our study, we empirically analyze the determinants of cross-countries IPRs protection with IPRs index of Ginarte & Park(1997) in 1995 and 2000. The results show that there is positive relationship between the level of economic development and IPRs protection, and that relationship is not simple linear but U-typed one. In addition, ability of technological development and institutional factors also have significant effects on IPRs protection.It means that we must consider the position of less developed countries in international discussion on IPRs protection and that relationship in doing researches relating to IPRs.
