인터넷통신판매중개자의 법적 책임

2002년 제정된 전자상거래 등에서의 소비자보호에 관한 법률(이하 전자상거래소비자보호법이라 약칭한다)은 통신판매업자와 통신판매중개자의 법적 책임 및 소비자보호를 위한 방법을 제시하고 있다. 그러나 전자상거래소비자보호법에서는 통신판매업자나 통신판매중개자가 자신의 면책을 주장할 가능성을 폭넓게 인정하고 있으며, 법 규정에서도 통신판매중개자의 면책을 규정함으로써 소비자보호가 아니라 사업자를 보호하기 위한 법으로 평가받고 있다. 전자상거래소비자보호법에서는 통신판매중개자와 관련하여 통신판매중개자의 개념을 명확하게 규정하고 있지 않아, 거래에 실질적으로 관여하기 때문에 통신판매업자로 평가받아야할 자에게도 통신판매중개자의 지위를 부여하고 있다는 문제점을 내포하고 있다. 또한 전자상거래소비자보호법 제20조에서는 통신판매중개자의 면책가능성을 넓게 인정함으로써 소비자보호를 위해 특별히 마련된 통신판매중개자의 법적 책임을 무력화 시키고 있다는 비판을 면하기 어려워 보인다. 모든 통신판매중개자는 소비자이용약관에 자신의 면책을 규정하는 방법과 통신판매의뢰자와의 통신판매의뢰계약에서 자신의 면책을 규율하는 방법을 통해 통신판매중개자에게 부과된 법적 책임을 회피할 수 있기 때문이다.올바른 소비자보호를 위해서는 전자상거래소비자보호법에 통신판매중개자의 법적 개념을 명확하게 규정해야 하며, 현행법에서 통신판매중개자에게 통신판매의뢰자의 신원 등에 관한 정보의 제공의무를 부과하고 있는 것 외에 의뢰자의 신원에 관한 정보확인의무를 새로이 부과해야 할 것이다. 또한 통신판매중개자가 면책을 주장할 수 있는 경우를 제한하는 방향으로 전자상거래소비자보호법에 개정되어야 진정으로 소비자를 보호하는 법률로서 역할을 할 수 있을 것이다.
Abstract
Act on the Consumer Protection in the Electronic Commerce Transaction (hereinafter referred to as “ACPECT”) enacted in 2002 provides legal liability of mail order seller or internet sale intermediary and mechanism for consumer protection.In terms of internet sale intermediary, ACPECT defines its scope broadly and thus treats as an internet sale intermediary a person who is substantially involved in e-commerce and will be classified into a mail order seller. This is one of ACPECT's shortcomings.Furthermore, section 20 of ACPECT is criticized in that a broad range of safe harbor provisions for internet sale intermediaries weakens their legal liability specifically stipulated for consumer protection. It is because every internet sale intermediary can avoid his or her legal liability imposed on him or her by including safe harbor provisions into standardized form contract for consumers or into a contract related to offer for mail order sale.ACPECT need to clearly define legal concept of internet sale intermediary for the purpose of sound consumer protection and to add new provisions related to duty to identify an offeror.Also, ACPECT will function as a statute effectively protecting consumers when it is amended in a way to limit the scope of safer harbor provisions for internet sale intermediary.
