스토킹 행위에 대한 규제와 피해자화 방지전략에 대한 고찰

The stalking behaviors became the one of troublesome problems of modern society. There are many cases where stalking victims are telephoned intermittently from strangers and followed and watched secretly at night. In that cases the victims usually experiences serious anxiety and fears through the continuous harassment by the stalker. However, the criminal sanctions for the stalkers are not effective to protect the victims from the harassment. Because the harassment behavior like telephoning, following and giving flowers is not a crime or misdemeanor. The criminal sanctions for the stalkers are imposed only by the criminal courts. whereas most of the stalking behaviors are committed continuously and repeatedly. As a result of the continuous stalking behaviors many stalking victims are experienced the serious traumatic injuries like insomnia and anthropophobia. In order to prevent the stalking behaviors and harassment, it is very necessary to legislate the police regulations and the stalking prevention acts which give policemen the regulating authorities to prevent the harassment on the spot and to give warnings to stalkers. And there must be prescribed the effective sanctions in the stalking prevention acts which imposes the stalkers to serve in prison through the conviction and have an psychiatric counseling when stalkers violate the police warnings repeatedly or harasses the victims after police warnings. It is also necessary to establish the stalking prevention center which have the authority to help the stalking victims and to regulate the stalkers through the stalking prevention staffs.
