우리나라 환경분쟁조정제도의 현황과 발전방안

초록
환경분쟁조정제도는 환경분쟁조정법(이하 '동법'이라 한다)에 의해 설치된 환경분쟁조정위원회(環境紛爭調整委員會)에 의하여 운영되는 제도이다. 동법 제1조(目的)에 의하면 환경분쟁의 알선ㆍ조정 및 재정의 절차등을 규정함으로써 환경분쟁을 신속ㆍ공정하고 효율적으로 해결하여 환경을 보전하고 국민의 건강 및 재산상의 피해를 구제함을 목적으로 한다고 규정하고 있다.동법에서 사용하는 용어의 정의는 다음과 같다(동법 제2조). "환경피해"라 함은 사업활동 기타 사람의 활동에 의하여 발생하였거나 발생이 예상되는 대기오염, 수질오염, 토양오염, 해양오염, 소음ㆍ진동, 악취, 자연생태계파괴, 일조방해, 통풍방해, 조망저해 그 밖의 대통령령이 정하는 원인으로 인한 건강ㆍ재산ㆍ정신에 관한 피해를 말한다, 다만, 방사능오염으로 인한 피해를 제외한다. 그 밖의 대통령령이 정하는 원인"이라 함은 진동이 그 원인 중의 하나가 되는 지반침하(광물채굴로 인한 지반침하를 제외한다)를 말한다(동법 시행령 제2조)."환경분쟁"이라 함은 환경피해에 대한 다툼과 환경기술개발 및 지원에 관한 법률 제2조 제2호의 규정에 의한 환경시설의 설치 또는 관리와 관련된 다툼을 말한다."조정(調整)"이라 함은 환경분쟁에 대한 알선ㆍ조정 및 재정을 말한다."다수인관련분쟁"이라 함은 동일한 원인으로 인한 환경피해를 주장하는 자가 다수인 환경분쟁을 말한다.
Abstract
When individuals need to resolve their disputes with other individuals, they may often go not only to courts for trial but also to alternative dispute resolution ("ADR"). This article deals with the efficient operation of environment dispute mediation in Korea, In Chapter 2 Environmental Dispute Adjustment of America, Germany and Japan is roughly summarized. Chapter 3 reviews the status of environment dispute resolution system in Korea. Finally, chapter 4 proposes the improvement schemes for the problems in the environment dispute resolution system. The writer of this article emphasized the affirmative functions and roles of Environmental Dispute Adjustment, which is also called Alternative Dispute Resolution. In particular, the 'Environmental Pollution Damage Dispute Mediation Act' was enacted in 1990, and the Central Environmental Dispute Mediation Committee(CEDMC) became a standing organization. The total rate of adjusted disputes by the CEDMC was over 84% from 1991 to 2007. In 1997 the extent of environmental dispute were magnified by changing the 'Environmental Dispute Mediation Act(EDMA)'. The EDMA provides for the remedy for environmental pollution with good offices, arbitrations, and adjudications
