자녀 국제인도에 관한 헤이그 협약의 내용과 사례

최근 교통․통신의 발달과 세계화 경향으로 인하여 다른 문화권이나 국가 간의 교류가 급속도로 증가하고 있으며 이러한 교류의 증가는 사적인 생활영역에도 영향을 미쳐 국제결혼 역시 증가하고 있다. 그런데 국제결혼은 종교적․문화적 배경이 다른 자들 사이의 혼인이므로 혼인 당사자들은 이러한 차이로 인하여 많은 갈등을 겪게 된다. 이들의 혼인관계가 이혼이나 별거 등으로 파탄에 이르게 되는 경우 국제결혼의 특성상 자녀와의 관계에 있어 일반적인 이혼과는 다른 문제점이 나타나고 있다. 즉, 이혼한 부 또는 모가 자신이 종교적․문화적으로 친숙한 모국에서 자녀를 양육하기 위하여 이혼 후 자녀와 함께 모국으로 이동하는 예가 많이 발생하고 있다. 이 경우 만일 자녀를 양육하고자 하는 자에게 양육권이 있다면 특별히 문제되지 않을 것이며 자녀의 안정된 성장과 복리를 위하여 바람직할 수도 있다. 그러나 자녀와 함께 국제적으로 이동하려는 부 또는 모에게 양육권이 없다면 양육권자의 권리를 침해하는 것이 될 뿐 아니라 양육권자는 국제 이동이라는 특성상 양육권이 있음에도 불구하고 자신의 자녀와 만날 수조차 없게 되는 심각한 상황에 처하게 된다. 이러한 위법상태를 구제하기 위하여 1980년 10월 25일, 헤이그국제사법회의(Hague Conference on Private International Law) 제14차 회기에서 “자녀의 국제 인도의 민사적 측면에 관한 헤이그 협약(Hague Convention on the Civil Aspects of International Child Abduction : 이하 협약이라고 한다)”이 채택되어 1983년 12월 1일부터 발효되었다. 이 협약은 양육권 없는 부 또는 모에 의하여 국외로 탈취된 자녀를 그가 종래 거주하던 상거소로 신속하게 인도하는 것을 목적으로 하는 것으로 궁극적으로는 자녀가 국외로 탈취되는 사태를 방지하고자 하는 것이다. 우리나라는 1997년에 헤이그국제사법회의의 회원국으로 가입하였으나 아직 이 협약의 체약국은 아닌 상태이다. 우리나라에서도 최근 국제결혼과 국제이혼이 급속도로 증가하고 있는 현실을 감안할 때 협약을 비준하여야 할 필요성이 크다고 할 수 있다. 뿐만 아니라 우리나라는 1991년 유엔아동권리협약(UN Convention on the Rights of the Child)을 비준하여 아동의 복리에 많은 관심을 가지고 있다. 아동의 복리를 최우선으로 고려하고자 하는 정신은 국제결혼이 파탄에 이르게 되고 그들 사이에 자녀가 있는 경우에도 동일하게 적용되어야 할 것이다. 이 논문에서는 이러한 필요성에 따라 협약의 내용과 외국의 입법례 및 판례를 검토하고 분석함으로써 우리나라에서 협약이 발효될 때를 대비하여 우리의 현실에 맞는 제도를 정비할 수 있는 방안을 연구하고자 한다.
Abstract
A Study on the Hague Convention on the Civil Aspects of International Child Abduction Kim, Mi-Kyung* The recent developments in transportation, telecommunication, and increased cultural interchanges result in many bi-national marriages. However such international marriages are also bringing numerous conflicts caused by cultural and religious differences in couples. In cases where such bi-national married couples are divorced or separated from one another, either of the couple who has rights of custody of the child may return to his or her homeland without the consent of the other parent. The international relocation of the child not only infringes upon rights of custody, but also severs the relationship between the child and the other parent. To resolve this problem, which is categorically considered child abduction, the Hague Conferences on Private International Law adopted "Hague Convention on the Civil Aspects of International Child Abduction(The 1980 Hague Convention)" at its 14th session held on October 25, 1980. This agreement is a product of a multilateral convention whose contracting states have been gradually increased to 78 nations as of June 16th, 2006. The expanding number of participating nations to the convention implies not only that the circumstances needing the application of the agreement are increasing but also that such applications are making progress. The primary purpose of the convention is to promptly return the child to his or her habitual residence and ultimately promote welfare of the child by providing him or her a stable environment to grow up and form their characteristics. In this study, the main content of the convention is reviewed for the preparation of Republic of Korea's prospective membership to the convention. The information regarding central authority, habitual residence, the rights of custody, reasons for exceptions of return and the rights of access are reviewed in details. In addition, the researcher investigates problems encountered in actual applications of the convention by reviewing related judicial precedents of other contracting states such as the United States, Great Britain, Germany, and France. Furthermore, the study reviews and compares domestic laws implemented by such contracting states for the execution of the convention and discusses how Republic of Korea should form a domestic law regarding international child abduction following its membership to the convention. It has been 25 years since the 1980 Hague Convention has become first effective. Nevertheless, Republic of Korea is still not a contracting state of the convention and there have been few attempts on deliberation about the convention. Increasing cases of international divorce and social trends in which the welfare of a childtakes top priority suggest that the membership of Republic of Korea to the 1980 Hague Convention is more urgently required.
