한국과 일본에서의 ‘로스쿨’ 논의

이 글은, 2004년 4월 1일부터 ‘일본식 로스쿨’인 법과대학원제도를 출범시킨 일본과, 2007년 7월 3일 법학전문대학원 설치운영에 관한 법률안의 국회 통과로 ‘로스쿨’ 시대에 접어든 한국에서, ‘로스쿨’을 둘러싼 논의가 어떻게 전개되어 왔고, 어떻게 전개될 것인지, 그리고 그 의미는 무엇인지를, 한일간의 비교라는 시각에서 살펴본 것이다. 이 글은, 1990년대 중반 이후 한일 양국에서 전개된 ‘로스쿨’ 논의를, 과정과 내용과 현황 및 과제의 측면에서 검토하고, 그것을 개혁 대 개선, 개혁의 강도, 개혁의 주체라는 각도에서 비교해보았다.그러한 검토와 비교를 통해, 이 글은, 1) 한국과 일본 모두, 정원제 선발시험을 중심으로 하는 법률가양성제도의 총체적인 기능부전과 국제화 및 法化의 진전에 따른 새로운 수요에 적절하게 대응하지 못한 결과, 미국의 제도인 로스쿨을 모델로 한 기본틀의 개혁으로서 ‘로스쿨’제도를 도입하게 되었으며, 2) 양국에서의 개혁의 강도는 법률가 숫자의 통제라는 장애를 얼마나 극복해낼 수 있을 것인가에 달려있으며, 3) 일본에서는 경제계, 정계, 변호사단체 등의 지지와 지원 속에서 ‘로스쿨’제도가 도입되었지만, 한국에서는 그렇지 못했다는 사실들을 밝히고, 4) 그 모든 사정 때문에, 한일 양국의 ‘로스쿨’제도의 미래는 그 담당주체인 법학교수들이 얼마나 노력하는가에 달려있다는 점을 지적했다.
Abstract
Debates on ‘Law School' in Korea and JapanKim, Chang-Rok*攀* Associate Professor, College of Law, Kyungpook National University ; chrkim@knu.ac.kr攀攀This paper examines the debates on 'law school' in Korea and Japan. The 'law school' system based on American model started on April 1, 2004 in Japan and was adopted on July 3, 2007 in Korea, where the legal system had been following the German concept. What made Korea and Japan receive this 'alien' legal education system? What would be the future of the 'law school' system in Korea and Japan? What do the changes in the two countries mean? This paper tries to find the answers to these questions with the comparison between Korea and Japan.This paper examines the processes, contents, present situation and remained issues of the debates on 'law school' since 1990's in Korea and Japan, and compares them from the perspectives of reform vs. improvement, intensity of reform and subjects of reform. Based on the examination and comparison, this paper clarifies the facts that 1) both Korea and Japan could not help but receive the American-style law school system, because the two countries could not properly cope with the total malfunctioning of the existing legal education system and the new demands stemming from radical internationalization and legalization, 2) the intensity of the reform in the two countries mainly depends upon how well they could overcome the hurdle of the 'control of lawyers number', 3) whereas the 'law school' system has been received in Japan with the help and cooperation from economic, political and legal circles, there have been no such help or cooperation in Korea. And this paper also points out the fact that 4) the future of 'law school' system in Korea and Japan will be determined by the efforts of law professors, who will take charge of the system.
