남북관계의 측면에서 대량살상무기확산방지구상(PSI)에 대한 국제법적 검토

As the new administration took over the power in the Republic of Korea(ROK), the possibility of full participation of the ROK government in Proliferation Security Initiative(PSI) became high. There are concerns about its potential negative effects on the inter Korean relations as the Democratice People's Republic of Korea (DPR Korea) has reservations on the legitimacy and legality of PSI. There is another concern that the full participation in PSI would hurt the inter Korean relationship given the possibility that the Inter Korean Maritime Agreement may replace PSI in preventing the proliferation of WMD by DPR Korea. However. this paper argues that PSI is in conformity with the international law order, especially the Law of the Sea. Furthermore the Inter Korean Maritime Agreement cannot substitute for PSI as the purpose and actions under the Inter Korean Maritime Agreement are different from those of PSI.
