청소년의 성보호에 관한 법률 제정의 정책결정과정에 관한 연구

초록
본 연구는 2000년 청소년의성보호에과한법률제정의 정책결정과정을 분석하는 것을 통하여 향후 청소년복지관련 정책결정과정에 대한 이론적기초를 제공하고자 하였다. 본 연구의 연구방법은 문헌연구와 주요참여자의 면접방법으로 연구하였다. 정책결정과정은 Kingdon모형에 따라 문제의 흐름, 정치의 흐름, 대안의 흐름 등 과정의 흐름과 참여자의 흐름을 통해 살펴보았고, 이러한 흐름이 어떻게 결합하여 정책의 창이 열렸는지 고찰한 후에, 다원주의 관점에서 정책결정과정을 분석하였다. 연구결과 청소년의성보호에관한법률의 정책의 창은 1999년 9월 국민회의가 주최한 청소년성매매처벌등에 관한 법률안 공청회였다. 청소년 성매매 문제를 인식하고, 최초로 청소년 성매매 방지와 관련된 사회적 대책 마련에 관심을 기울이기 시작한 집단은 청소년보호위원회였다. 청소년보호위원회는 청소년의성보호에관한법률이 제정되기까지 주도적인 역할을 담당한 것으로 나타났다. 청소년의성보호에관한법률의 제정과정에서는 청소년보호위원회, 여성단체, 정당인 국민회의 등이 서로 협력한 것으로 나타났다. 여성단체는 청소년의성보호에관한법률 제정을 위한 여론형성과 각계 각층의 의견을 수렴하고, 시민의 참여를 유도하는 역할을 담당하였고, 국민회의는 미성년자 매매춘금지정책기획단을 구성하는 등 청소년성매매 방지와 관련된 법안 마련에 주력하였다. 청소년의성보호에관한법률의 제정과정을 다원주의 관점에서 분석하면 정부의 역할 측면을 제외한 권력의 소재, 주요 참여자 집단의 수, 성격, 정책결정과정의 구조, 성격, 결정된 정책의 내용의 측면에서 다원주의론으로 설명하는 것이 적합하다고 할 수 있다.
Abstract
The purpose of this study is to analyze the policy making process of law of youth protection for sexual criminals in order to theoretically explain youth welfare policy making process. The study of literature and interview of principal participant were used method of policy making process of law of youth protection for sexual criminals. The Policy Making process were investigated according to Kingdon's policy stream model and were analyzed by viewpoint of pluralism. The consequence of study is following. The policy window of law of youth protection for sexual criminals was the public hearing about law of prevention of buying and selling of youth sex by the society of people, on sep, 1999. Youth protection committee recognized the problems of buying and selling of youth sex and leaded to provide social countermeasure of the problems of buying and selling of youth sex. And, youth protection committee cooperated the society of people and organization of woman in policy making process of law of youth protection for sexual criminals. Organization of woman formed public opinion on prevention of buying and selling of youth sex and the society of people provided policies(alternatives) on prevention of buying and selling of youth sex. The policy making process of law of youth protection for sexual criminals were explained by pluralism.
