國家權力 내지 統治構造의 正當化原理

초록
현대의 모든 국가권력 내지 통치구조는 국민주권의 이념을 토대로 하면서도 간접민주주의를 지향하고 있다. 이때 간접민주주의는 국민주권의 이념에 따라 실현되어야 하는 것이기 때문에 정당화가 추구되어야 하며, 그것은 혁명을 통하여 새로운 국가권력을 창설하는 경우는 물론이고 선거를 통하여 합법적으로 구성된 기존의 국가권력도 예외가 될 수 없다.국가권력의 정당화원리를 역사적으로 평가할 때 상당기간 2가지 정당화원리가 대립되어 왔다. 18세기에는 국민주권원리가 주장되면서 군주주권원리와 대립하였다. 19세기에는 국가기능과 관련하여 경찰국가사상과 야경국가사상의 대립이 있었다. 20세기에 들어서면서 국민주권의 이념이 실질화 되면서 전통적 정당성과 합리적 정당성이 대립하며 발전을 유도하였다.그러나 20세기 후반 이후 국가권력의 정당화원리는 대립보다는 합치된 방향으로 정리되고 있다. 그것은 국가기능의 변화를 사회국가원리의 시각에서 인식하기 시작한 결과라고 할 수 있다. 그 결과 현대국가의 정당화원리는 다음과 같은 3가지 방향에서 평가되고 있을 뿐 상호 대립적으로 평가하지 않는다. 민주적 정당성, 목적적 정당성, 절차적 정당성이 그것이다.이 논문은 민주적 정당성, 목적적 정당성, 절차적 정당성의 문제가 현대국가의 정당화원리라고 평가하고, 그 구체적인 의미와 내용을 살펴보았다. 그리고 이 국가권력의 정당화원리가 헌법해석의 지침이 되어야 한다는 의미에서, 우리 헌법해석상 구체적으로 논의될 분야를 직접 살펴보고 헌법해석시 주의해야 할 점을 강조하였다.
Abstract
Legitimation of the Governmental PowerLee, Seung-WooModern nations are destined to pursue representative democracy. And the national ruler must enjoy the recognition of the people whether he is the creator of a new government or currently in power. Otherwise he/she will be liquidated whether by a revolution or through a legal election.Human history developed the principle of legitimation through the friction of two opposing values. In the 18th century there was a friction between the monarchal sovereignty and the peoples' sovereignty. The 19th century was evolved by the friction between the police state and the night watch state. In the 20th century there was a friction between the traditional legitimacy and rational legitimacy.However, we notice that these opposing principles of legitimation were amalgamated in the recent years. In other words, integration overruled opposition. And we may amplify this principle into the following three subcategories: democratic legitimacy, objective legitimacy, and procedural legitimacy.This article is an attempt to investigate the detailed aspects of these three categories. And the Constitutional Court of Korea should be formed with this principle of legitimation.
