사립학교법 개정과정과 주요내용 분석

This study aims at making an analysis of the amendment process and major contents of private school law promulgated in December 29, 2005. For these, it made a division into three stages such as raise of issues, formation of alternative plans and legislation based on the central participants time and space of main subjects, who have an effect on the amendment discussion of private school law, to arrange their active contents by each stage. Main amendment contents are as follows: Article 14–introduction of open director system, Clause 2, Article 18–making and opening conference records of director board, Article 21–strengthening participation restriction of relative directors and introduction of open audit system, Article 22–strengthening comeback restriction to school of absurd executives, Article 25–elimination of temporary directors’ term of office, Article 29–consultation with an operating committee about school accounts, Article 31–submission of outside institution’s audit reports, Article 53–guarantee of principal’s term of office, Clause 2, Article 53-introduction of open selection system for new teachers, Clause 3, Article 54–exclusion of chief director’s relations when appointment of principle. In the result, it had objects in extending transparency and democracy, publicness of school operation. Moreover, it got into an argument over questions after the amendment of private school law.
